AN ORDINANCE AMENDING CHAPTER 166 OF THE LOUISVILLE METRO CODE OF ORDINANCES RELATING TO THE LOUISVILLE METROPOLITAN SEWER DISTRICT'S NOTIFICATION OF ANNEXATION REQUESTS SENT FROM SUBURBAN CITIES.

WHEREAS, The Legislative Council of the Louisville/Jefferson County Metro Government ("the Council") occasionally receives annexation requests from suburban cities pursuant to KRS 67C.111(3); and
WHEREAS, KRS 67C.111(3) requires the Council to approve or deny such requests within sixty (60) calendar days of receipt of said request; and
WHEREAS, the Council believes that such decisions should not be made lightly due to the potentially serious impact on the impacted property owners, the impacted residents, Louisville Metro taxes, road funds, Public Works projects, and planning decisions in the area subject to annexation; and
WHEREAS, the statutory period for action requires such review start as quickly as possible so that the Council has sufficient time to review relevant information and make an informed decision; and
WHEREAS, previous resolutions the Council has passed on the subject of annexations have been insufficient to ensure the process is as informative and efficient as possible; and
WHEREAS, the Council passed Ordinance Number 11, Series 2021, creating Chapter 166 of the Louisville Metro Code of Ordinances (the "LMCO") in order to create a more permanent, easily accessible, and amendable version of its annexation rules to ensure it receives adequate and timely information from Metro agencies about each annexation request before Council must make its final decision; and
WHEREAS, since the creation of LMCO Chapter 166, the Louisville Metropolitan Sewer District ("MSD") has requested to be included in the notification provisions of the ordinance; and
