AN ORDINANCE RELATING TO THE DECISION OF THE PLANNING COMMISSION TO APPROVE THE REVISED DISTRICT DEVELOPMENT PLAN PROPOSED IN CASE NO. 22-DDP-0067. (AS AMENDED)

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") has reviewed the evidence presented at the public hearing held by the Development Review Committee (the "DRC") of the Louisville Metro Planning Commission (the "Planning Commission") and the findings and decision of DRC as set out in the minutes and records of the DRC in Case No. 22-DDP-0067; and
WHEREAS, the Council concurs in and adopts the findings of DRC for the revised district development plan in Case No. 20-DDP-0067 and approves and accepts the recommendation of DRC as set out in said minutes and records, with the addition of binding elements;
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISIVLLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I: That the revised district development plan for the property located at Parcel IDs 004702930000 and 004702940000 on Old Heady Road and being in Louisville Metro, as proposed and more particularly described in the minutes and records of DRC in Case No. 22-DDP-0067, is hereby approved., with the following additional binding elements:
10. The density on site shall not exceed 7.49 dwelling units per acre.

11. Any significant increases to the proposed structures (e.g. increases in building height, number of units, number of buildings), any increase in density on the property, any changes in use on the property which directly or indirectly require a public hearing before the Planning Commission or subcommittee thereof, and/or any amendments to the binding elements, other than (i) the addition of new binding elements, (ii) changes to binding elements that merely update the public hearing date, or (iii) updating a previous versio...
