TITLE
AN ORDINANCE CLOSING PORTIONS OF SOUTH 23RD STREET, HEMLOCK STREET, OLIVE STREET, CYPRESS STREET, A 14 FOOT WIDE ALLEY BETWEEN WOODLAND AVENUE AND WILSON AVENUE AND AN 18 FOOT WIDE ALLEY BETWEEN HEMLOCK STREET AND BEECH STREET AND BEING IN LOUISVILLE METRO FOR THE CREATION OF THE WILSON QUIET ZONE (CASE NO. 14STREETS1014-1019).

WHEREAS, the Louisville Metro Planning Commission, as set forth in the minutes and records of Case No. 14STREETS1014-1019, has recommended to the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") that closing the portions of six streets and alleys in Louisville Metro as herein described will be a necessary element to finalize the Wilson Quiet Zone as shown in detail in the Planning Commission's staff report dated August 4, 2016 (see attachment 3) which is a project that began in early 2000 with the Kentucky Transportation Cabinet and the Norfolk Southern Railway; and
WHEREAS, the closings comply with the goals and objectives of the Comprehensive Plan; and
WHEREAS, the Council concurs in and adopts the findings of the Planning Commission in Case No. 14STREETS1014-1019 and approves and accepts the recommendations of the Commission as set out in said minutes and records;
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
Section I: That the portions of South 23rd Street, Hemlock Street, Olive Street, Cypress Street, a 14 foot wide alley between Woodland Avenue and Wilson Avenue and an 18 foot wide alley between Hemlock Street and Beech Street and being in Louisville Metro as more particularly described in the minutes and records of the Planning Commission in Case No. 14STREETS1014-1019 and as shown on the attached plats be closed, subject to all existing easements of record and all exiting utility easements or rights enjoyed by ...
