AN ORDINANCE AMENDING LOUISVILLE METRO CODE OF ORDINANCES § 76.03 REGARDING TRUCK TRAFFIC RESTRICTIONS ON CERTAIN STREETS.

WHEREAS, 49 USCA §31114, prohibits restricting commercial motor vehicle access to interstate highways except when the restriction is based on safety considerations; and
WHEREAS, from 2014-2018 there were 116 documented vehicular crashes on Eastern Parkway, Willow Avenue, and Cherokee Parkway; and
WHEREAS, Louisville Metro Council believes that restricting commercial motor vehicle access to these roads will decrease the number of safety hazards and the amount of money spent on repairs in these areas.
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I. LMCO § 76.03 is hereby amended to read as follows:
§ 76.03 TRUCKS RESTRICTED ON CERTAIN STREETS.
It shall be unlawful for the operator of any truck which weighs more than 21,000 pounds, including the load, to use any of the following streets, except for the purpose of loading or unloading:
