TITLE
AN ORDINANCE AMENDING THE LOUISVILLE METRO CODE OF ORDINANCES SECTIONS 51.300(C), 51.405(A), AND 51.500(A) REGARDING THE FREQUENCY OF COLLECTING YARD WASTE AND RECYCLING IN THE URBAN SERVICES DISTRICT AND HOUSEHOLD WASTE ON CERTAIN HOLIDAYS IN SAME DISTRICT (AMENDED BY SUBSTITUTION).

WHEREAS, Louisville Metro Government is seeking ways in which to create a balanced budget and finds that cuts to services are needed in solid waste collection; and
WHEREAS, Louisville Metro Government amends the frequency in which the Urban Service District ("U.S.D.") collects yard waste and recycling.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I: Louisville Metro Code of Ordinances ("LMCO") Section 51.300(C)(3), regarding Waste Haulers' License to Operate, is amended as follows:
(3) To obtain and maintain the license, waste haulers collecting putrescible waste operating within the county must offer a basic service package to all residential customers. The basic service offered must consist of once-a-week curbside collection of household waste;.; Additionally, for waste haulers other than the Department in the Urban Services District, regulated by Sections 51.400-51.405, basic service must consist of a minimum of once-a-week once every other week seasonal collection of yard waste; and a minimum of once-a-week curbside once every other week collection of recyclables. Other alternative collection service scenarios may be used if approved by the Board. Haulers must provide for the collection of the following recyclable materials at a minimum: newspaper; aluminum and steel cans; clear, green and brown container glass; HDPE and PETE plastic bottles and jugs.
SECTION II: LMCO Section 51.500(A), Mandatory Solid Waste Collection, is amended as follows:
