AN ORDINANCE DEDICATING TO THE CITY OF BELLEMEADE THE PORTION OF NORTH CHADWICK ROAD BETWEEN SHELBYVILLE ROAD AND WHIPPS MILL ROAD THAT LIES WITHIN THE CITY OF BELLEMEADE SO THAT THE RESPONSIBILITY, CONTROL AND MAINTENANCE WILL BE BORNE BY THE CITY OF BELLEMADE (AS AMENDED).

WHEREAS, in 1947 North Chadwick Road was dedicated to Jefferson County as a 60-foot wide public right-of-way known as Chadwick Road (see Attachment A), as contained in Minute Order Book __, pages ________ (see Attachment B, transcribed as Attachment C)Plat Book 9, Page 39, as on record in the Office of the Jefferson County Clerk; and
WHEREAS, on October 28, 2003, the Louisville Metro Government, via Ordinance No. 198, Series 2003, created the Louisville Metro Through Road System, an amalgamation of the designated through roads of the former City of Louisville and Jefferson County; and
WHEREAS, North Chadwick Road, a former Jefferson County through road, was designated part of the Louisville Metro Through Road System as CR-10291019H and currently runs 0.59 miles from Shelbyville Road Parkway (US 60) to Whipps Mill Road (CR-1005) (see Attachment DB); and
WHEREAS, North Chadwick Road is almost entirely encompassed by the City of Bellemeade, with the exception of a small portion just north of its intersection with Shelbyville Road (see Attachment EC); and
WHEREAS, the City of Bellemeade has asked Louisville Metro Government to dedicate North Chadwick Road to the City of Bellemeade so that the City of Bellemeade may assume control and maintenance of the public right of-way and relieve Louisville Metro Government thereof; and
WHEREAS, the Louisville Metro Department of Public Works and Assets supports the transfer of the North Chadwick Road right-of-way to the City of Bellemeade (see Attachment FD), provided the road remains open and available to the public;
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: The public right-of-way known as North Chadwick and identified as CR-1029 in the Louisville Metro Through Road System is hereby dedicated to the City of Bellemeade so that the City of Bellemeade may assume control and maintenance of the public right-of-way and relieve Louisville Metro Government thereof.
SECTION II: This transfer is conditioned on North Chadwick Road remaining a public road which is open to use by the general public. Any proposal to close the road or transfer it from a public road to a private road shall require the review and approval of the Louisville Metro Council.
SECTION III: This Ordinance shall become effective after: (1) its passage and approval; and (2) passage and approval of an ordinance by the City of BellemeadeJeffersontown accepting dedication of the right-of-way.
