A RESOLUTION AUTHORIZING THE MAYOR TO SUSPEND ORDINANCE 081, SERIES 2019 OF THE FISCAL YEAR 2019-2020 OPERATING ORDINANCE AS RELATES TO THE PROCEDURES FOR DISTRIBUTING FUNDS TO EXTERNAL AGENCY FUND (EAF) RECIPIENTS AS A RESULT OF THE NOVEL CORONAVIRUS (COVID-19) PANDEMIC.

WHEREAS, Metro Government understands that the novel coronavirus (COVID-19) pandemic has created significant financial hardship on external agency recipients who are on the front lines providing services throughout the Louisville Metro community;
WHEREAS, Metro Government currently requires external agencies to provide timely documentation in order to receive monthly or quarterly allotments and maintain fiscal compliance;
WHEREAS, it is recommended that Metro Government amend the procedures for distributing funds to external agency recipients through a modified release process with the understanding that the external agency recipients will provide appropriation documentation, programs, and services whenever feasible;
WHEREAS, Metro Government wishes to take advantage of this opportunity;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I. The Mayor is hereby authorized to suspend the reporting and distribution procedures of Ordinance 081, Series 2019 of the fiscal year 2019-2020 operating ordinance applicable to external agency fund (EAF) recipients, in response to the novel coronavirus (COVID-19) pandemic. The Mayor may allow for distribution of funding during fiscal year 2019-2020 to the various recipient agencies who are unable to provide the services and programs during the fourth quarter of fiscal year 2019-2020 due to coronavirus (COVID-19) pandemic-related events and closures beyond their control with the understanding that the affected recipients will endeavor to provide such services and programs as soon as practical and feasible during fiscal year 2020-2021.
SECTION II. Notwithstanding the provisions of Section I, recipients of any EAF distributions for fiscal year 2019-2020 programs or services that are not delivered on or before March 31, 2021 shall return unspent funds and provide financial reports accounting for expenditures related to the canceled event.
SECTION III: This Resolution shall take effect upon its passage and approval.
