A RESOLUTION REQUESTING THE PLANNING COMMISSION REVIEW THE LAND DEVELOPMENT CODE REGULATIONS WITH REGARD TO HEAVY TRUCK PARKING.

WHEREAS, The Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) has taken notice of issues surrounding the parking of heavy trucks; and

WHEREAS, Heavy truck parking is prohibited in residential areas, requiring residents who own heavy trucks to park them away from their residences; and 

WHEREAS, Heavy truck parking is only permitted in a few zoning districts; and

WHEREAS, The limited availability of heavy truck parking in many areas leads to violation of the LDC; and

WHEREAS, Heavy truck-driven shipping is an integral part of the Louisville economy; and

WHEREAS, There are multiple potential options to address this apparent shortage, including expanding the zones where heavy truck parking is allowed by right, permitting heavy truck parking in new zones with standards, and/or permitting heavy truck parking in new zones with a Conditional Use Permit;

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I:                     The Planning Commission shall undertake a review of the current Land Development Code and adopt amendments thereto to update it with regards to heavy truck parking.

SECTION II: Per KRS 100.211 (3) and the current COVID-19 related State of Emergency, the Planning Commission shall hold at least one (1) public hearing and make a recommendation to Metro Council within sixty (60) days of the conclusion of the suspension of KRS 100 deadlines or sooner if able.  If the Planning Commission fails to issue a recommendation within that period, Metro Council reserves the right to move forward without such recommendation.

SECTION III: This Resolution shall take effect upon its passage and approval.
