AN ORDINANCE APPROVING THE SOUTH FLOYDS FORK VISION PLAN AND APPROVING ITS EXECUTIVE SUMMARY AS AN AMENDMENT TO THE PLAN 2040 COMPREHENSIVE PLAN (CASE NO. 19AREAPLAN0002) (AS AMENDED).

WHEREAS, the Louisville Metro Planning Commission held a public hearing on September 19, 2019 on approving the South Floyds Fork Vision Plan and approving an amendment to the Plan 2040 Comprehensive Plan to incorporate the Plan’s Executive Summary in case No. 19AREAPLAN0002; and

                     WHEREAS, the Planning Commission found that the South Floyds Fork Vision Plan (the “Plan”) conforms to the adopted Goals of the Plan 2040 Comprehensive Plan and the incorporation of the Plan’s Executive Summary into Plan 2040 also conforms to the adopted Goals of the Plan 2040 Comprehensive Plan; and

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) has considered the evidence presented at the public hearing held by the Louisville Metro Planning Commission and the recommendations of the Commission and its staff as set out in the minutes and records of the Planning Commission in Case No. 19AREAPLAN0002; and

WHEREAS, the Council concurs in and adopts the findings and recommendations of the Planning Commission approving the Plan and approving an amendment to Plan 2040 to incorporate therein the Executive Summary of the Plan in Case No. 19AREAPLAN0002 with an additional changes to Recommendation 4B and 5A to the Plan and to the Executive Summary of the Plan, and approves and accepts the recommendations of the Planning Commission as set out in said minutes and records, with the following changes to Recommendation 4B and 5A to the Plan and the Executive Summary of the Plan:

4B Wherever possible roadways should be buffered from tree clearing. Rather than prohibit logging practices entirely in the area, this recommendation would maintain a buffer of trees and vegetation between public roadways and logging operations. This would reduce the visual impact of tree clearing on roadways and other scenic areas.;

 

5A Consider establishing buffer standards for new development that is proposed adjacent to permanently protected active agricultural uses.Establish a 50 foot natural/vegetative buffer in new development adjacent to permanently protected land. reasonable buffer standards when new non-agricultural development is proposed adjacent to land that is permanently protected by a conservation easement. Property owners are strongly encouraged to work together to develop adequate buffers in these cases. In determining the width of the buffer, the size of the parcel being developed and the intensity of the new development should be taken into consideration, as well as the potential negative impact of the new development upon the land that is protected by the conservation easement. For larger, more intense developments, a 50 foot natural/vegetative buffer may be reasonable. Smaller, less intense developments may require a narrower buffer.

 

NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I:                     That the Plan included in the records of the Planning Commission in Case No. 19AREAPLAN0002 and amended by the Council is hereby adopted.

SECTION II:                     The Executive Summary of the Plan included in the minutes and records of the Planning Commission in Case No. 19AREAPLAN0002 and amended by the Council is hereby adopted as an amendment to the Plan 2040 Comprehensive Plan.

SECTION III:  This Ordinance shall take effect upon its passage and approval.
