A RESOLUTION DETERMINING AN UNIMPROVED TRACT LOCATED AT 2622 ADRIENNE WAY IN LOUISVILLE, KENTUCKY, SHOWN ON EXHIBIT "A" ATTACHED HERETO, OWNED BY THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT ("METRO GOVERNMENT"), AS SURPLUS AND NO LONGER NEEDED FOR A GOVERNMENT PURPOSE AND AUTHORIZING THE UNIMPROVED TRACT, ALL IN METRO LOUISVILLE, KENTUCKY (THE "TRACT"), TO BE CONVEYED TO THE LANDBANK AUTHORITY (AS AMENDED).

                     WHEREAS, according to KRS 67C.101, Metro Government, may enact resolutions for the municipal purpose of sale or conveyance of real property owned by Metro Government; and

                     WHEREAS, the real property which is the subject of this resolution is mostly non-buildable due to its location in a flood prone area, the 40-foot front building limit line, and its heavy encumbrance by utility easements; and

                     WHEREAS, Metro desires to convey the subject property to Landbank Authority to be sold as a side yard; and

                     WHEREAS, Section 1(A) of Executive Order No. 2, Series 2011, of the Metro Mayor, which adopts Section 2(C) of Executive Order No. 3, Series 2007 provides that Metro Government may sell and convey surplus real estate upon a determination by the Legislative Council of Metro Government ("the Council") that such property is no longer needed for the governmental purpose of Metro Government; and

                     WHEREAS, the Tract, as described in Exhibit “A” attached hereto and made a part hereof, is surplus and no longer needed for a governmental purpose as certified by the Certification of Surplus Property; and

                     WHEREAS, the Tract has no improvements located thereon and will be conveyed to the Landbank Authority for the has an appraised value of $2,500.00.

                      NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“COUNCIL”) AS FOLLOWS:

 

                     SECTION I:  The Council determines that the real property described in Exhibit A hereto is no longer needed to carry out the governmental functions of Metro Government.

                     SECTION II:  That the Metro Mayor or his qualified designee are hereby authorized to transfer the properties named herein, in the manner provided according to Section 2 of Executive Order No. 3 Series 2007 of the Metro Mayor to the Landbank Authority for consideration of one dollar ($1.00) two thousand five hundred and 00/100 dollars ($2,500.00).

                     SECTION III: This Resolution shall become effective upon its passage and approval.

2622 ADRIENNE WAY, LOUISVILLE, KY

 

BEING Lot 31, CORONET VILLAGE, plat of which is of record in Plat and Subdivision Book 12, Page 84 in the Office of the Clerk of Jefferson County, Kentucky, less and except so much as was sold off by deed dated March 9, 1971 and recorded in Deed Book 4418, Page 214, and described as follows:

 

Beginning at a point in the Southwest corner of Lot #31 of the aforementioned Coronet Village, said point being in the right of way line of Adrienne Way; thence with the West line of Lot #31 N 05 degrees 36’ West, 68.30 feet to a point in the permanent easement line of Mill Creek Drainage Ditch; thence S 67 degrees 50’ East with the permanent easement line, 40.04 feet to a point; thence S 16 degrees 28’ West, 56.26 feet to the right of way line of Adrienne Way; thence on an arc, radius of which is 40 feet being the right of way for Adrienne Way, said arc being subtended by a chord which has a bearing of N 84 degrees 33” West a distance of 15.28 feet to the point of beginning.  Said tract contains a total of 1654.6 sq. ft. or 0.0359 acres.

 

BEING a part of the property conveyed to Metro Government by a Deed dated November 8, 1970 and of record in Deed Book 4384, Page 470 in the aforementioned Clerk's Office.
