A RESOLUTION PURSUANT TO THE CAPITAL AND OPERATING BUDGET ORDINANCES, APPROVING THE APPROPRIATION TO FUND THE FOLLOWING NONCOMPETITIVELY NEGOTIATED AMENDMENT TO PROFESSIONAL SERVICE CONTRACT FOR LOUISVILLE METRO PUBLIC HEALTH AND WELLNESS ("LMPHW") CONCERNING COVID-19 TESTING - (VITALITY DX, LLC - $200,000.00 FOR A NEW NOT-TO-EXCEED AMOUNT OF $650,000.00).

WHEREAS, in accordance with Kentucky Revised Statutes Chapters 39A and 39B, Mayoral Executive Order 2020-001 declared an emergency and authorized measures necessary to respond to the COVID-19 pandemic; and
WHEREAS, pursuant to that Executive Order, Metro Government executed a Contract with Vitality DX, LLC for COVID-19 testing; and
WHEREAS, the continued need for testing services has led LMPHW to request an increase in the not-to-exceed amount of the Contract; and
WHEREAS, the portion of the Executive Order addressing emergency procurement measures has expired.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I: The following appropriation for the listed amendment to contract is hereby approved:
LOUISVILLE METRO PUBLIC HEALTH AND WELLNESS
$200,000.00 for a new not-to-exceed amount of $650,000.00 for an amendment to the noncompetitively negotiated Professional Service Contract with Vitality DX, LLC for COVID-19 testing from January 15, 2021 through December 31, 2021.
SECTION II: This Resolution shall take effect upon its passage and approval.
