AN ORDINANCE AMENDING SECTION 36.03 OF THE LOUISVILLE METRO CODE OF ORDINANCES (“LMCO”) RELATING TO PARTICIPATION IN THE KENTUCKY LAW ENFORCEMENT FOUNDATION PROGRAM FUND.

WHEREAS, during the 2022 Regular Session of the Kentucky General Assembly, detectives employed by a county attorney and local alcoholic beverage control investigators were added to the list of officers qualifying for the Kentucky Law Enforcement Foundation Program Fund; and

WHEREAS, Louisville Metro Council wishes to codify the participation of those officers in Kentucky Law Enforcement Foundation Program Fund training incentives. 

NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:

 

SECTION I:  LMCO § 36.03 is hereby amended as follows:

   (A)   Metro Government declares its intention to participate in the Kentucky Law Enforcement Foundation Program established by and pursuant to KRS 15.410 through 15.510. Metro Government agrees to comply with the requirements of KRS 15.410 to 15.510 or the administrative regulations issued by the Justice Cabinet under KRS 15.410 to 15.510.

   (B)   The Finance Director shall deposit in an appropriate account, which can be identified separately from all other sources of revenue, all moneys received by the Metro Government pursuant to KRS 15.410 through 15.510.

   (C)   Promptly on receipt of moneys under KRS 15.410 through 15.510 the Finance Director subject to KRS 15.490(2) shall cause to be paid to each police officer of the Metro Government as defined in KRS 15.420 the applicable amount received on behalf of that officer and shall provide each officer a check stub on which the gross amount of money paid to him or her under KRS 15.410 through 15.510 and all pertinent information relating to deductions therefrom are set out.

   (D)   The Finance Director shall cause all financial records relating to moneys received pursuant to KRS 15.410 through 15.510 to be retained for a period of three years and until the completion of an audit approved by the appropriate department of the Commonwealth of Kentucky and the United States Law Enforcement Assistance Administration.

   (E)   The Metro Police Department and each officer thereof shall comply with all applicable provisions of KRS 15.410 through 15.510 and 15.990 and with all reasonable rules and regulations appropriate to the Police Department and the officers thereof issued by the Kentucky Justice Cabinet to facilitate the administration and further the purposes of KRS 15.410 through 15.510.

   (F)   On behalf of detectives employed by the Jefferson County Attorney, that office shall comply with KRS 15.410 through 15.510 and such rules, regulations, and policies as may be reasonably prescribed by the Kentucky Justice Cabinet to facilitate the administration and further the purposes of KRS 15.410 through 15.510.

   (G)   On behalf of local alcoholic beverage control investigators appointed pursuant to KRS Chapter 241, the Louisville Metro Government Alcoholic Beverage Control Administrator shall comply with KRS 15.410 through 15.510 and such rules, regulations, and policies as may be reasonably prescribed by the Kentucky Justice Cabinet to facilitate the administration and further the purposes of KRS 15.410 through 15.510.

SECTION II: This Ordinance shall take effect upon its passage and approval or otherwise becoming law.
