AN EMERGENCY RESOLUTION INITIATING A REVIEW OF THE DECISION OF THE DEVELOPMENT REVIEW COMMITTEE OF THE PLANNING COMMISSION TO APPROVE A REVISED DISTRICT DEVELOPMENT PLAN FOR THE PROPERTY LOCATED AT PARCEL IDS 004702390000 AND 004702940000 ON OLD HEADY ROAD IN LOUISVILLE METRO.

WHEREAS, the Development Review Committee of the Planning Commission held a public hearing on November 16, 2022 on a proposal to revise the District Development Plan and modify the binding elements for the property at Parcel IDs 004702390000 and 004702940000 on Old Heady Road in Louisville Metro (22-DDP-0067), and the Committee voted to approve the plan by a vote of 5 For, 0 Opposed on November 16, 2022; and
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (“Council”) has the power and authority under the provisions of the Land Development Code (“LDC”), Section 11.7.5, to review and uphold, modify, or overturn that decision, and may place additional conditions or binding elements as it deems appropriate; and
WHEREAS, because of the potential impact of the increased density on Old Heady Road and Chenoweth Run Road, as well as the significant changes proposed a just over a year since the property was rezoned in Ordinance Number 130, Series 2021, the Council finds that such a review is warranted; and
WHEREAS, This Ordinance requires emergency consideration as authorized by Council Rule 7.01 because the limitations of the regular Council calendar combined with the requirements of LDC Section 11.7.5 would make it impossible to review this matter without either emergency passage or the scheduling of several special meetings.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“COUNCIL”) AS FOLLOWS:
SECTION I: The Council hereby initiates a review of the November 16, 2022 decision of the Development Review Committee of the Planning Commission to revise the District Development Plan for the property at 004702390000 and 004702940000 on Old Heady Road in Louisville Metro. The Planning and Zoning Committee shall conduct a review of the Plan on Tuesday December 6, 2022, only rescheduling if necessary. This hearing shall consist of a review of the record before the Development Review Committee by Planning and Design Staff, followed by the answering of questions posed by Council members and discussion. Public comment will not be taken.
SECTION II: This Resolution shall take effect upon its passage and approval or otherwise becoming law.
