OF THE LOUISVILLE METRO CODE OF ORDINANCES (“LMCO”) RELATING TO  
CRIMINAL ACTIVITY NUISANCES AND IN-PERSON SECURITY AT LATE-NIGHT  
BUSINESSES. (AMENDMENT BY SUBSTITUTION)

Owen, that this Ordinance be amended by substitution, as shown in the  
attached document titled "O-280-25 PROPOSED CABS 072226 Late-Night

A motion was made by Committee Member Ruhe, seconded by Committee  
Member Joseph, that this amended by substitution Ordinance be amended, as  
shown in the attached document titled "O-280-25 V.2 CABS 072226 Late-Night  
Business Security.pdf" to read as follows:  
PERSISTENT ILLEGAL ACTIVITY PROPERTY.  
(1) Any premises or property meeting one of the following two criteria:  
(a) Properties other than hotels and motels where law enforcement officers  
have conducted an Enforcement Action for a violation listed in subsection (2)  
of this definition on more than one occasion in any 12 month period; or  
(b) Hotels and motels where law enforcement officers have conducted an  
Enforcement Action for a violation listed in subsection (2) of this definition on  
at least five occasions in any 12 month period.  
(2) For the purposes of determining whether the time period for an  
Enforcement Action has been met, each occurrence of a violation listed in this  
subsection begins a new 12-month period:  
(a) Prostitution and/or human trafficking offenses under KRS Chapter 529;  
(b) Sexual offenses under KRS Chapter 510 with the exception of KRS 510.150;  
(c) Gambling offenses under KRS Chapter 528;  
(d) The sale or use of alcoholic beverages on or from either licensed or  
unlicensed premises;  
(e) Misdemeanor or felony possession, trafficking, or manufacturing drug  
offenses under KRS Chapter 218A;  
(f) Murder under KRS 507.020 and manslaughter under KRS 507.030 and KRS  
507.040;  
(g) Assault or related offenses under KRS Chapter 508;  
(h) Theft offenses under KRS Chapter 514;  
(i) Drug paraphernalia offenses as defined by KRS 218A.500 and KRS 218A.510;  
(j) Unlicensed massage therapy under KRS 309.353;  
(k) Violations of LMCO §§ 115.170 to 115.186;  
(l) Selling smoking retail products, as defined by LMCO § 90.02, without a  
license as required by LMCO § 90.11; or  
(m) Violations of LMCO § 135.03 for discharging a firearm.
