AN ORDINANCE AUTHORIZING LOUISVILLE METRO GOVERNMENT TO RENEW THE GAS FRANCHISE WITH LOUISVILLE GAS & ELECTRIC COMPANY AND SIGN A GAS FRANCHISE AGREEMENT.

WHEREAS, on May 26, 2016, Metro Council authorized Louisville Metro Government to advertise a gas franchise bid; and
WHEREAS, Louisville Gas & Electric Company submitted a bid responsive to such terms and conditions; and
WHEREAS, Metro Council approved Louisville Gas & Electric Company’s Gas Franchise Agreement on August 25, 2016 and it was executed and filed with the Kentucky Public Service Commission on August 30, 2016; and
WHEREAS, Metro Council set the terms and conditions of the franchise bid as a 5-year renewable agreement, totaling not more than 20 years; and
WHEREAS, Metro Council approved the first renewal of Louisville Gas & Electric Company’s Gas Franchise Agreement on June 10, 2021 and it was executed and filed with the Kentucky Public Service Commission on June 24, 2021; and
WHEREAS, Louisville Metro and Louisville Gas & Electric Company, pursuant to Section 9 of said Louisville Gas & Electric Company Gas Franchise Agreement, wishes to renew the agreement for another five-year term.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“LOUISVILLE METRO COUNCIL”) AS FOLLOWS:
SECTION I. Louisville Metro Council hereby approves the extension of the current Louisville Gas & Electric Company Gas Franchise Agreement for five additional years, as authorized by the current Franchise Agreement, from August 30, 2026 through August 30, 2031.
SECTION II. Louisville Metro Council authorizes Louisville Metro Government to enter into the attached gas franchise agreement renewal with Louisville Gas & Electric Company.
SECTION III. This Ordinance shall take effect upon its passage and approval or otherwise becoming law.
