RESOLUTION NO. ______, SERIES 2026

TITLE

A RESOLUTION AMENDING THE RULES OF THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT REGARDING PRESIDING OFFICER AT COMMITTEE MEETINGS.

WHEREAS, the Kentucky Revised Statute § 67C.103(10) authorizes the Louisville/Jefferson County Metro Government Council (“Council”) to determine and adopt its own rules; and

WHEREAS, under Council Rule 1.14, the Council shall determine its own rules, and under Council Rule 1.01(d) may amend its Rules by a resolution adopted by a two-third’s vote of the entire Council; and

WHEREAS, the Council wishes to amend its rules to provide parameters for chairing committee meetings conducted under Rule 5A.

                      NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

                     SECTION I: Rule 4.06 of the Metro Council Rules is hereby amended as follows:

4.06  Conduct of Committee Meetings

Except as otherwise provided in these Rules, committee meetings shall be governed as follows: 

a)  Except as provided in Rule 5A.03, the Chair shall preside at meetings of the committee. If the Chair is absent, the Vice Chair shall assume the duties of the Chair.

b)  The Chair shall direct the order of presentation of the arguments for and against matters for consideration by the committee, and shall permit questions to be asked by Members of the Council. Except as otherwise provided in applicable rules and policies for zoning matters, the Chair may permit members of the public and the Administration to speak on a matter, provided such speakers maintain proper order and decorum. 

c) The Chair, in consultation with the Clerk’s office, shall set the committee agenda. The Chair shall set the date and time for any continued hearing and shall notify the Clerk’s office of such.  

d)  The Clerk’s office shall be responsible for posting the committee agenda. An agenda for each committee meeting shall be published at least one (1) working day prior to the committee meeting, and shall be posted in conformance with state law. The agenda shall be composed of items referred by the Council or Committee on Committees as well as items within the committee work plan. 

e) The Chair may call a special meeting of his/her respective committee to consider any item referred to it. Notice of a meeting of a committee shall be given to the Clerk no later than twenty-four (24) hours prior to the meeting, excluding weekends. The Clerk shall give all appropriate notices as provided for by law.

SECTION II:                     Rule 5A.03 of the Metro Council Rules is hereby amended as follows:

5A.03   Conduct of Meeting Re-Noticed as a Video Teleconference 

a) If a meeting is re-noticed as a meeting by video teleconference any member may participate virtually in that meeting.   

b) Only those members of a committee or Council who are present in person or who are participating virtually in a meeting that has been noticed by the Clerk as a video teleconference may count toward the quorum requirement for that meeting.  

c) Any Council Member participating by video teleconference in any committee meeting or Council meeting must keep his/her camera on for the entire duration of the meeting.

d) Council Members may not participate by video teleconference in any committee meeting or Council meeting while operating a motor vehicle.

e) The presiding officer of a committee meeting conducted pursuant to Rule 5A shall be determined as follows:

1. If the committee chair is attending virtually, and the committee vice-chair is present in person, the vice-chair shall preside over the meeting.

2.  If both the committee chair and the committee vice-chair are attending virtually, they shall designate a committee member present in person to preside over the meeting.

3.   If the committee meeting is a fully virtually meeting, then the presiding officer shall be determined in accordance with Rules 4.01 and 4.06.

SECTION III:  This Resolution shall take effect upon its passage and approval.
