AN ORDINANCE RELATING TO THE REVISED DETAILED DEVELOPMENT PLAN FOR PROPERTY LOCATED AT 6605 WEST ORELL ROAD CONTAINING APPROXIMATELY 12.89 ACRES AND BEING IN LOUISVILLE METRO (CASE NO. 21DDP0083)(AS AMENDED).

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) previously approved the zoning change in connection with 6605 West Orell Road pursuant to Ordinance No. 238, Series 2017 (the “2017 Ordinance”); and
WHEREAS, as part of the 2017 Ordinance, any change of use or change to the approved development plan shall require Metro Council review and approval; and
WHEREAS, the Council has considered the evidence presented at the public hearing held by the Louisville Metro Planning Commission (the “Planning Commission”) and the recommendations of the Planning Commission and its staff as set out in the minutes and records of the Planning Commission in Case No. 21DDP0083; and
WHEREAS, the Council concurs in and adopts the findings of the Planning Commission for the zoning change in Case No. 21DDP0083 and approves and accepts the recommendation of the Planning Commission as set out in said minutes and records, with an additional binding element.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: That the revised district development plan zoning of the property located at 6605 West Orell Road containing approximately 12.89 acres and being in Louisville Metro, as more particularly described in the minutes and records of the Planning Commission in Case No. 21DDP0083, is hereby approved; provided, however, said property shall be subject to the binding elements and the condition of approval as set forth in the minutes of the Planning Commission in Case No. 21DDP0083., with the following additional binding element:
10. Applicant shall revise the development plan to lower Building 3 to two stories and associated calculations including number of units.
SECTION II: This Ordinance shall take effect upon its passage and approval or otherwise becoming law.
