A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A GRANT AGREEMENT UP TO A TOTAL OF $70,000.00 WITH THE KENTUCKY TRANSPORTATION CABINET, DEPARTMENT OF HIGHWAYS, TO EXECUTE ANY DOCUMENTS NECESSARY TO FACILITATE AND ADMINISTER, THROUGH THE DEPARTMENT OF PUBLIC WORKS & ASSETS, THE ACCEPTANCE OF FUNDS TO DESIGN AND CONSTRUCT A REALIGNED OLD BARDSTOWN ROAD TO ALIGN WITH THE ENTRANCE TO WALGREENS AT HILLOCK DRIVE IN JEFFERSON COUNTY.

WHEREAS, Louisville Metro Government wishes to enter into a grant agreement up to a total of $70,000.00 with the Kentucky Transportation Cabinet, Department of Highways, to execute any documents necessary to facilitate and administer, through the Department of Public Works & Assets, the acceptance of funds to design and construct a realigned Old Bardstown Road to align with the entrance to Walgreens at Hillock Drive in Jefferson County; and
WHEREAS, the Louisville Metro Government and the Kentucky Department of Transportation (herein “KYTC”) have negotiated an Agreement, a copy of which is attached hereto as Exhibit A (herein the “Agreement”), pursuant to which KYTC shall pay up to Seventy Thousand Dollars ($70,000.00) to Louisville Metro Government for the Project; and
WHEREAS, the Department of Public Works & Assets will be the lead agency and perform all phases of the Project, which will enhance the safety and reliability of the roadway; and
WHEREAS, Paragraph 26 of the Agreement provides that the Legislative Council of Louisville/Jefferson County Metro Government will pass a resolution authorizing the Mayor to enter into the Agreement and ratifying and adopting all statements, representations, warranties, covenants, and agreements contained in the Agreement; and
WHEREAS, Louisville Metro will receive benefits from the realignment of Old Bardstown Road.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE “COUNCIL”) AS FOLLOWS:
 
SECTION I: The Council does hereby ratify and adopt all statements, representations, warranties, covenants, and agreements contained in said Agreement and does hereby accept the funds provided in said Agreement and by such acceptance agrees to all the terms and conditions therein stated.
SECTION II: The Mayor is hereby authorized to enter into a grant agreement with the Kentucky Transportation Cabinet, Department of Highways.
SECTION III:  This Resolution shall become effective upon its passage and approval or otherwise becoming law.
