AN ORDINANCE AMENDING LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES (“LMCO”) CHAPTER 76 TO REGULATE TEMPORARY CLOSURES OF METRO PARK ROADS TO VEHICULAR TRAFFIC.

WHEREAS, the Louisville Metro Council recently passed an ordinance regulating the temporary closure of roads within Metro Parks; and 

WHEREAS, that ordinance permitted the Cherokee Park scenic loop to maintain its current traffic pattern until September 1, 2021; and

WHEREAS, after September 1, 2021, that current traffic pattern can only continue if it receives approval from Metro Council prior to that date; and

WHEREAS, a public meeting to discuss the current traffic pattern is currently scheduled for August 17, 2021; and

WHEREAS, Metro Parks will report the results of that public meeting to Metro Council prior to September 1, 2021; and

WHEREAS, the September 1, 2021 deadline necessitated filing this ordinance prior to the public meeting in order to preserve the option of maintaining the current traffic pattern should that option receive significant public support; and

WHEREAS, if that public meeting evidences that the community supports the current traffic pattern Metro Council wishes to allow Metro Parks to maintain that traffic pattern; and

WHEREAS, this ordinance is not meant to take any position on whether the current traffic pattern should be made permanent but merely seeks to preserve Metro Council’s flexibility to implement the results of whatever the outcome of the Metro Parks public meeting might be;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

                     SECTION I:  LMCO § 76.10 is amended as follows:

§ 76.10                     METRO PARK ROAD SYSTEM, TEMPORARY CLOSURES.

  (C) The following modifications to subsection (A) are specifically authorized by Council:

       (1)  If the recommendation of Metro Parks following the August 17, 2021 community meeting regarding Cherokee Park is to maintain the current traffic pattern; and if the report to Council of the results of the public meeting evidences significant support for the current traffic pattern in Cherokee Park; then Metro Parks shall have the discretion to temporarily be permitted to close the roads in the park until September 1, 2021, except that Metro Parks shall not close the portions of the scenic loop from Eastern Parkway to Barret Hill and Cochran Hill Road to Ledge Road. These two sections of the scenic loop must have one lane open to vehicle traffic unless further Council action is taken.  until September 1, 2021. By September 1, 2021, Metro Parks shall have conducted a public meeting and shall have reported the results of that meeting to Metro Council as described in subsection (D). Any long-term closure of a road must be approved by Metro Council as described herein. If Metro Council has not approved a long-term closure of any roads in Cherokee Park prior to September 1, 2021, the roads in the park shall reopen to vehicle traffic as described in subsection (A) of this ordinance.

Section II: This Ordinance shall be effective upon its passage and approval.
