A RESOLUTION OF LOUISVILLE METRO GOVERNMENT, AGREEING TO ACCEPT THE ASSIGNMENT AND CONVEYANCE OF OWNERSHIP INTEREST AND MAINTENANCE OF THE RIGHT OF WAY FOR THE FAIRDALE ROUNDABOUT AS DESCRIBED HEREIN BY THE KENTUCKY TRANSPORTATION CABINET OFFICIAL ORDER #108739: ITEM #5-8501.00.

WHEREAS, Fairdale Road and Mitchell Hill Road, existing Louisville Metro routes, will be under a Kentucky Transportation Cabinet (KYTC) contract (Order #108739: Item #5-8501.00) to reconstruct a portion of said roads, and this work will be finalized upon the successful completion of said contract.
BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION I: KYTC and its agents are hereby authorized, in the name of Louisville Metro Government, to acquire right of way needed for this project according to the alignment and widths shown on the plans or revisions thereof, and is authorized to institute condemnation proceedings for acquisition of such right of way if necessary.
SECTION II: In exchange for the Kentucky Transportation Cabinet's commitment to reconstruct a segment of Fairdale Road and Mitchell Hill Road, Louisville Metro Government agrees to accept the assignment and conveyance of ownership interest and maintain or cause to be maintained the following facilities:
Fairdale Road - From station 114+35 to the proposed Fairdale Roundabout.
Mitchell Hill Road - From station 130+46 to the proposed Fairdale Roundabout.
SECTION III: Louisville Metro Government will accept, by deed or by KYTC Official Order, the assignment and transfer of ownership interest and maintenance responsibility of right of way and facilities upon completion of the aforementioned Fairdale Roundabout construction project.
SECTION IV: This Resolution shall take effect upon its passage and approval.
