AN ORDINANCE OF THE LOUISVILLE/JEFFERSON COUNTY METRO COUNCIL TO APPROVE THE ANNEXATION BY THE CITY OF JEFFERSONTOWN OF TWO TRACTS OF LAND, TRACT I APPROXIMATELY EASTERLY AND TRACT II APPROXIMATELY WESTERLY, BOTH IN THE COUNTY OF JEFFERSON, AND BOTH ADJOINING THE PRESENT CITY OF JEFFERSONTOWN, KENTUCKY, WITH TRACT 1 BEING ADJACENT AND CONTIGUOUS TO GENERALLY NORTHERLY AND EASTERLY AND TRACT II BEING ADJACENT AND CONTIGUOUS TO GENERALLY SOUTHERLY AND WESTERLY, AND BOTH BEING ADJACENT AND CONTIGUOUS WITH THE PRESENT BOUNDARIES OF SAID CITY AT THE SAME POINT ON CHENOWETH RUN ROAD AND TAYLORSVILLE ROAD, CONTIGUOUS WITH THE PRESENT BOUNDARY OF SAID CITY BUT NOT CONTIGUOUS TO THE PRESENT BOUNDARY OF THE FORMER CITY OF LOUISVILLE, AND BEING IN THE UNINCORPORATED AREA OF THE FORMER COUNTY OF JEFFERSON.

WHEREAS, on October 6, 2026, the City Council of the City of Jeffersontown, Kentucky voted in favor of an ordinance to annex the two tracts of property depicted in the annexation request packet received from Jeffersontown and more particularly described therein, which is incorporated herein by reference as if set forth in full (a copy of which is attached hereto); and
WHEREAS, the area proposed for annexation is adjacent to and contiguous with the present boundary of Jeffersontown; and
WHEREAS, the area proposed for annexation does not include any portion of Chenoweth Run Road or Easum Road as they are Metro/Jefferson County Through Roads; and
WHEREAS, the City of Jeffersontown believes it is in a position to provide municipal services to the area proposed for annexation; and
WHEREAS, the City of Jeffersontown filed a request on Thursday, October 15, 2026 with the Office of the Metro Council Clerk requesting that the Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) approve the annexation of the two tracts of property described above (a copy of which is attached hereto); and
WHEREAS, KRS 67C.111(3) requires the City of Jeffersontown obtain approval of the annexation from the Council prior to the City of Jeffersontown proceeding with the annexation requirements under KRS Chapter 81A; and
WHEREAS, under changes made by the Kentucky General Assembly to KRS 67C.111(3) for annexation requests filed after July 15, 2024, “If the ordinance is accompanied by a petition in favor of the proposed annexation sighed by a number of registered and qualified voters residing in the area proposed to be annexed which is equal to at least seventy-five percent (75%) of the total number of votes case in the area in the last preceding presidential election, the consolidated local government shall approve the annexation”; and
WHEREAS, the City of Jeffersontown has stated, in its Ordinance No. 1488, Series 2026, that the petition attached thereto is signed by “an amount equal to more than ninety-five (95%) percent of the registered and qualified voters who voted in the last Presidential election [within the annexation area]”; and
WHEREAS, KRS 67C.111(3)(b) provides that the Council’s decision “shall be made by ordinance and within sixty (60) days of the receipt of the request” and that if the Council does not act “within sixty (60) days, the request for a city to proceed with an annexation proposal shall be deemed to be approved”; and
WHEREAS, for the reasons stated above, the Council wishes to proceed with approval of the City of Jeffersontown’s annexation ordinance to become effective upon passage and approval.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“METRO COUNCIL”) AS FOLLOWS:
SECTION I: The Council hereby approves the annexation of the two tracts of property depicted in the annexation request packet received from Jeffersontown and more particularly described therein, but not to include any portion of either Chenoweth Run Road or Easum Road as they are Metro/Jefferson County Through Roads, as proposed by the City of Jeffersontown in its Ordinance No. 1488, Series 2026, on October 6, 2026 (attached hereto) pursuant to its authority under KRS 67C.111(3).
SECTION II: This Ordinance shall take effect on passage and approval.
