An Ordinance AMENDING the Provisions of Chapter 153 of LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES (LMCO) RELATING TO Planning. (AS AMENDED)

WHEREAS, the Department of Community Services and Revitalization, through its Community Revitalization division is responsible for providing property management and disposition services for property owned by the Louisville and Jefferson County Land Bank Authority, Inc., the Urban Renewal and Community Development Agency of Louisville and certain properties owned by Louisville-Jefferson County Metro Government.
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the Council) undertook the re-adoption and amendment process for Chapter 153 of the Louisville/Jefferson County Metro Government Code of Ordinances in Ordinance No. 100, Series 2007, and No. 6, Series 2008, and
WHEREAS, since that time the Council has determined that a portion of LMCO Chapter 153, related to Planning, needs additional amendment for purposes of supporting the development and redevelopment of vacant housing, abandoned property and other underutilized real estate, and
NOW, THEREFORE; BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION I: LMCO Chapter 153 is hereby amended as follows:
ยง 153.02 PLANNING COMMISSION FEE SCHEDULE.
The Planning Commission fee schedule found in Appendix 11B to Chapter 11 of the Land Development Code is hereby updated as follows:
1) All application fees otherwise charged by Planning and Design Services shall be waived (except for notice and advertisement fees, clerk fees or any other third party fees) for the following applicants:
a) All persons or entities applying for development plan review, street closures, zoning map amendments, subdivisions, conditional uses, change of use, variances and waivers and zoning certification letters where said person or entity has acquired title to the subject property from the Louisville and Jefferson County Land Bank Authority, Inc., the Urban Renewal and Community Development Agency of Louisville or Louisville- Jefferson County Metro Government.
b) This fee waiver is applicable in all areas of Metro Louisville for a period of 12 months from the date that title to the subject property is transferred to the grantee.
2) This fee waiver is applicable only to applications filed by the original grantee of the above-listed agencies or their successors with written verification from the Department of Community Services and Revitalization or its successors in staffing the aforementioned agencies.
Section II: This Ordinance shall take effect upon passage and approval.
