AN ORDINANCE IMPOSING A TEMPORARY MORATORIUM ON REZONING, CONDITIONAL USE PERMIT, MAJOR SUBDIVISION, AND PLAN CERTAIN, CATEGORY 2B AND 3 DEVELOPMENT PLAN APPLICATIONS FOR RESIDENTIAL DEVELOPMENT IN THE SYSTEM DEVELOPMENT CHARGE AREA.

                     WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (“Council”) acknowledges that the System Development Charge Areas (“SDC Areas”), as hereinafter defined, are areas of substantial growth and development which do not have sufficient roadway infrastructure to safely and efficiently handle any further development that generates additional traffic;

                     WHEREAS, for the purposes of this Ordinance the SDC Areas are shown on Exhibit A attached hereto; 

                     WHEREAS, the Council believes that a temporary pause in development will enable the Louisville Metro Department of Public Works in cooperation with the Kentucky Transportation Cabinet to develop a plan for improving the roadway infrastructure in the SDC Areas in order to accommodate the anticipated growth of traffic volume created by new development;

                     WHEREAS, the Council would like to create a period wherein no new residential development applications, including without limitation, rezoning, conditional use permit, major subdivision and plan certain, category 2B and 3 development plan applications will be accepted while plans are developed to improve the roadway infrastructure in the SDC Areas and to ensure that new development does not overwhelm the roadway capacity;

WHEREAS, it is anticipated that such study and planning will take approximately six months to initiate and complete; and

WHEREAS, during the pendency of such study and planning, the Council desires to preserve the status quo by preventing changes to the existing land uses.                      

NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“COUNCIL”) AS FOLLOWS:

 

SECTION I:                     There is hereby imposed a moratorium on the acceptance and further processing by Louisville Metro Planning & Design Services, Louisville/Jefferson County Metro Planning Commission, and Louisville/Jefferson County Metro Board of Zoning Adjustment of any applications for residential rezoning, conditional use permits, major subdivisions, and Plan Certain, Category 2B and 3 development plans in the SDC Areas.

SECTION II:                       The Council hereby requests that the Louisville Metro Department of Public Works in cooperation with the Kentucky Transportation Cabinet undertake a study of the SDC Areas to identify roadways that need improvements to accommodate the anticipated growth of development in the SDC Areas.

 SECTION III:                      The Council hereby requests that the Planning Commission, through its staff in Metro Planning and Design Services, study and consider adopting regulations requiring concurrency in the approval of new development with roadway infrastructure sufficiently adequate to accommodate trips generated by the development proposals.

SECTION IV:                      This Ordinance shall take effect upon passage and approval and shall remain in effect for a period of one hundred eighty (180) calendar days after its effective date unless repealed or extended.
