A RESOLUTION RATIFYING AND APPROVING A COLLECTIVE BARGAINING AGREEMENT (THROUGH JUNE 30, 2021) RELATING TO WAGES, BENEFITS, AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT BETWEEN LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AND THE RIVER CITY FRATERNAL ORDER OF POLICE LODGE #614, POLICE OFFICERS AND SERGEANTS.

WHEREAS, pursuant to LMCO § 35.057, upon agreement between the parties to the Collective Bargaining Agreement, the Legislative Council of the Louisville/Jefferson County Metro Government must approve a resolution for the agreement to become final and binding; and

WHEREAS, a Collective Bargaining Agreement has been reached between Louisville/Jefferson County Metro Government and the River City Fraternal Order of Police Lodge #614, Police Officers and Sergeants through June 30, 2021; and

                     WHEREAS, Louisville Metro Government understands the calls for additional police reform and oversight but is bound by current state law; and

WHEREAS, Louisville Metro Government is hopeful that the Kentucky General Assembly will prioritize police reform in the 2021 legislative session; and

WHEREAS, Louisville Metro Government expects this reform to include:  increased ability to question officers after a critical incident; increased consideration of prior disciplinary actions in subsequent cases; limitations on involved officers’ access to non-public information prior to public release; increased civilians’ ability to raise concerns about police conduct; elimination of the restrictions on public statements after officers have been charged with a violation of policy; addition of subpoena authority to Civil Review Board; authorization for an Officer of Inspector General to conduct into non-criminal police conduct simultaneously with internal police investigations; and authorization for the Chief of Police to delegate disciplinary authority; and

WHEREAS, Louisville Metro Government expects to begin negotiating a long-term collective bargaining agreement with the FOP in January of 2021, and

WHEREAS Louisville Metro Government expects to enact these changes and others in the long-term contract.

                     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I.  The Collective Bargaining Agreement (through June 30, 2021) reached between Louisville/Jefferson County Metro Government and the River City Fraternal Order of Police Lodge #614, Police Officers and Sergeants, for and on behalf of bargaining unit employees within the Louisville Metro Police Department concerning wages, other items of compensation, pension, terms of employment, benefits and other matters be, and the same hereby is, approved.  A copy of the Collective Bargaining Agreement is attached hereto.

SECTION II.                     This Resolution shall take effect upon its passage and approval.
