AN ORDINANCE CREATING A NEW SECTION OF CHAPTER 113 OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES TO ESTABLISH AN ENTERTAINMENT DESTINATION CENTER WITHIN THE NULU MARKETPLACE AREA (AS AMENDED).

WHEREAS, NuLu Marketplace, located at 815-825 E. Market Street is 0.9 miles from the Yum Center and 1.2 miles from the KY International Convention Center and will be a tourist destination that positively enhances the options for food and beverages for visitors to Louisville and community members;
WHEREAS, NuLu Marketplace will offer a Kentucky-based, nationally recognized brewery, a makers space for crafters, a mixology company offering education and fun, Detroit-style pizza, local apparel, a bourbon bar and small batch wellness products;
WHEREAS, Louisville Metro Government seeks to create an Entertainment Destination Center for NuLu Marketplace for which Nulu Commons, LLC, the owner of the property, will apply for a license from the Louisville Metro Alcoholic Beverage Control and the Kentucky Department of Alcoholic Beverage Control;
WHEREAS, KRS §243.030(21) authorizes the issuance of an Entertainment Destination Center (“EDC”) License by the Kentucky Department of Alcoholic Beverage Control;
WHEREAS, the state ABC regulations require the Louisville Metro enact an ordinance with the geographic boundaries of the EDC and a determination that the licensed premises would aid economic growth and tourism in the county or city (804 KAR 4:370); and
WHEREAS, Louisville Metro Council believes the creation of an Entertainment Destination Center in the NuLu Marketplace as defined in this ordinance will aid in the economic growth of tourism in Louisville Metro.
BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: A new section of Chapter 113 of the Louisville Metro Code of Ordinances (“LMCO”) is hereby created as follows:
§ 113.XX: NULU MARKETPLACE ENTERTAINMENT DESTINATION CENTER
(A) Louisville Metro hereby establishes an Entertainment Destination Center (“EDC”) at the NuLu Marketplace upon the belief that the NuLu Marketplace satisfies the requirements contained in the definition of an EDC as required by Section 1 of 804 KAR 4:370, including the belief that the NuLu Marketplace will aid economic growth and tourism in Louisville Metro and for the community around the NuLu Marketplace area.
(B) The geographical boundaries of the NuLu Marketplace EDC lies within and adjacent to the following description:
Beginning at a point on the North right-of-way line of East Market Street, said point also being the Southeast corner of the property and the Point of Beginning; thence running along said right-of-way, N 81°18'11" W, 157.50 feet to a point; thence leaving said right-of-way, N 8°49'15" E, 194.38 feet to a point in the South right-of-way line of Billy Goat Strut alley; thence along said alley right-of-way, S 81°14'55” E, 157.50 feet to a point; thence leaving said alley right-of-way S 8°49'15” W, 194.23 feet to the Point of Beginning, and containing .70 acres more or less.
The area designated for the EDC shall also include the sidewalks adjacent to the above-referenced parcel on East Market Street.
(C) The NuLu Marketplace EDC hours are as follows: Monday through Saturday 11:00 a.m. until 2:00 a.m. 12:00 am. and Sundays 11:00 a.m. until 11:00 p.m.12:00 a.m.
(D) The NuLu Marketplace shall comply with all applicable laws and licensing requirements to operate as an EDC.
SECTION II: This Ordinance shall take effect upon its passage and approval.
