A RESOLUTION DETERMINING 2.966 ACRES OF OTTER CREEK PARK LOCATED IN MEADE COUNTY, KENTUCKY, AS SHOWN ON EXHIBIT A ATTACHED HERETO AND OWNED BY LOUISVILLE/ JEFFERSON COUNTY METRO GOVERNMENT (“METRO GOVERNMENT”), THE GOVERNMENTAL SUCCSSOR TO THE CITY OF LOUISVILLE, AS NO LONGER NEEDED AND NO LONGER PRACTICAL FOR A GOVERNMENTAL PURPOSE AND AUTHORIZING ITS TRANSFER TO MEADE COUNTY.

WHEREAS, pursuant to KRS § 67C.101, Louisville/Jefferson County Metro Government (“Metro Government”) may sell or transfer any real property belonging to Metro Government;
WHEREAS, Section 1(A) of Executive Order No. 2, Series 2011 of the Mayor, which adopts Section 2(C) of Executive Order No. 3, Series 2007, provides that the Metro Government may sell and convey surplus real estate upon declaration by the Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) that such property is no longer needed for the governmental purposes of Metro Government;
WHEREAS, Metro Government owns 2.966 acres of Otter Creek Park located in Meade County, Kentucky as more particularly described in Exhibit A attached hereto (the “Property”);
WHEREAS, Metro Government previously transferred all of its interest in Otter Creek Park other than the Property (approximately 2,152 acres), to the Department of Fish and Wildlife for the continued operation of Otter Creek Park, pursuant to Resolution No. 34, Series 2014;
WHEREAS, the Department of Fish and Wildlife is now transferring its interest in Otter Creek Park to Meade County, which transfer is expected to be complete by June;
WHEREAS, there is an interest in conveying the Property to Meade County so that the entirety of Otter Creek Park will be under a single ownership;
WHEREAS, the Property contains a landfill that is now closed and located 26 miles from Jefferson County;
WHEREAS, Meade County is willing to acquire the Property as part of its overall operation of Otter Creek Park;
WHEREAS, the Property is no longer needed to carry out the governmental functions of Metro Government.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE “COUNCIL”) AS FOLLOWS:
SECTION I: The Council hereby determines that the Property described in Exhibit A hereto is no longer needed to carry out the governmental functions of Metro Government.
SECTION II: The Mayor is hereby authorized to take all necessary actions to transfer the Property to Meade County in the manner provided according to Section 2 of Executive Order No. 3, Series 2007, without further action by the Council.
SECTION III: This Resolution shall take effect upon its passage and approval or otherwise becoming law.

Commencing at a set rebar and cap, having Kentucky One Zone Coordinates with a Project Datum Factor of 1.00012059 of N: 3,862,492.45, E: 4,838,395.60, the True Point of Beginning:
Thence North 23°58’33” East a distance of 335.67 feet to a set rebar and cap;
Thence North 49°39’54” East a distance of 123.30 feet to a set rebar and cap;
Thence South 51°43’40” East a distance of 173.46 feet to a set rebar and cap;
Thence South 17°27’50” East a distance of 232.96 feet to a set rebar and cap;
Thence South 38°11’24” West a distance of 174.90 feet to a set rebar and cap;
Thence North 82°00’33” West a distance of 240.91 feet to a set rebar and cap;
Thence North 62°18’25” West a distance of 101.39 feet to a set rebar and cap; the True Point of Beginning, containing 2.966 acres, more or less.
Being part of the same property as that conveyed to the City of Louisville, a municipal corporation of the State Kentucky by the United States of America by Deed dated March 6, 1958, which is recorded in Deed Book 90, Page 617. Also being a part of the same property as conveyed to the City of Louisville, a municipal corporation of the State of Kentucky by Joseph Earl Richey by Deed dated February 1969, which is recorded in Deed Book 112, Page 93. All references are to the records of the Meade County Clerk.
