TITLE
AN ORDINANCE ESTABLISHING THE LOUISVILLE METRO CEMETERY BOARD.

WHEREAS, the Council desires to restore, maintain, and protect the non-profit and indigent cemeteries in Louisville Metro which do not receive perpetual care funds; and
WHEREAS, KRS 67.680 grants Kentucky counties the authority to create a county cemetery board by ordinance, which may apply to the Kentucky Department for Local Government for grants to restore and maintain nonprofit cemeteries that do not receive perpetual care funds pursuant to KRS 367.952;
BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION I: ESTABLISHMENT.
(A) There is hereby created the Louisville Metro Cemetery Board, hereinafter referred to as the “Board”.
(B) The Board is established for the purpose of facilitating the restoration and maintenance of nonprofit and indigent cemeteries that do not receive perpetual care funds pursuant to KRS 367.952.
(C) In carrying out its purpose, the Board shall perform a number of functions, including working with other local groups to identify and promote the maintenance and preservation of local cemeteries, applying for, accepting, and dispersing grant funds and donations through the Louisville Metro Parks Department to carry out its purpose, and assisting in developing appropriate projects.
SECTION II: MEMBERSHIP.
(A) The Board shall consist of five (5) volunteer members with no more than three (3) members representing the same political party. Members shall be appointed by the Mayor with the approval of the Louisville Metro Council, shall have lived in Jefferson County for at least one (1) year prior to appointment, and shall have demonstrated an interest in cemetery preservation, genealogy, local history or a related area.
(B) A member may be removed from office by the Mayor for misconduct, inefficiency, or willful neglect of duty. The Mayor must submit a written statement to the member setting forth the reasons for removal.
(C) Members shall serve without compensation, but shall be reimbursed for necessary expenses incurred in the performance of their duties subject to available funds and approval by the Board.
SECTION III: TERMS OF MEMBERS.
(A) The appointment term of each Board member shall be three (3) years, except for initial appointment terms. Initial appointment terms shall be staggered as follows: Two (2) members appointed to one (1) year terms; two (2) members appointed to two (2) year terms; and one (1) member appointed to a three (3) year term.
(B) All members shall serve until their successor is appointed and qualified. In filling vacancies prior to the expiration of the stated term of membership, the appointment of a successor shall be for only the unexpired term.
SECTION IV: MEETINGS; QUORUM.
(A) The Board shall meet not less than three (3) times annually in a space provided by Louisville Metro Government.
(B) A majority of the members of the Board shall constitute a quorum for transaction of business at any meetings of the Board.
SECTION V: BYLAWS; COMMITTEES; STAFFING; OFFICERS; REPORTS.
(A) The Board shall adopt bylaws and other rules as it deems necessary for its organization and proceedings consistent with the laws, ordinances and resolutions of the Commonwealth of Kentucky and Louisville/Jefferson County Metro Government.
(B) The Board may create standing and temporary committees for such purposes and needs as may arise in the performance of the Board’s duties.
(C) Staff assistance to the Board shall be provided by the Louisville Metro Parks Department.
(D) The Board shall elect a Chairman from its members. The Chair shall be elected annually.
(E) The Board shall provide a written report of its functions and operations with the Mayor and the Metro Council no later than July 30th of each year.
(F) The Board is subject to the Kentucky Open Meetings and Open Records laws.
SECTION VI: This Ordinance shall take effect upon its passage and approval.
