TITLE

A RESOLUTION AMENDING SECTION 4A.04(c) OF THE RULES OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT COUNCIL TO ADD A REMOVAL STANDARD.

WHEREAS, the Kentucky General Assembly amended Kentucky Revised Statute (“KRS”) § 67C.103 in 2017 to the Government Oversight and Audit Committee (“Committee”) with authority to “[r]ecommend the removal of any appointee to a board or commission described in” KRS § 67C.103(13)(f);

WHEREAS, upon the recommendation from the Committee, Metro Council may “remove an appointee to a board or commission described” in KRS § 67C.103(13)(f) upon a two-thirds (2/3) vote of the council;

WHEREAS, Louisville Metro Council amends its Rules to adopt a removal standard in the event the Government Oversight and Audit Committee seeks to recommend removal of a member of a board or commission; and

WHEREAS, Louisville Metro Council adopts the removal standard set forth in KRS § 65.007 that established the removal standard for appointed members of special districts in Kentucky.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE “COUNCIL”) AS FOLLOWS:   

 

Section I:                     Section 4A.04(c) of the Rules is hereby amended to create a new subsection 2 with the following language:

2.  Unless otherwise expressly provided by ordinance or statute, the removal standard for the Committee to consider and recommend the removal of any appointed member of a board or commission shall be for inefficiency, neglect of duty, malfeasance, or conflict of interest.

                     Section II: Subsections 2 through 6 in 4A.04(c) of the Rules are to be renumbered as 3 through 7.

Section II: This Resolution shall be effective upon its passage and approval.
