TITLE
AN ORDINANCE AMENDING THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES (“LMCO”) CHAPTER 42 TO ALLOW QUALIFIED GOLF PROFESSIONALS WITH THE PROFESSIONAL GOLFERS’ ASSOCIATION OF AMERICA TO OPERATE NO MORE THAN 27 HOLES OF LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT’S (“METRO”) GOLF COURSES.

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the “Council”) takes notice of the difficulty Metro Parks (“Parks”) has encountered in attempting to recruit and retain qualified golf professionals with the Professional Golfers’ Association of America (“PGA”) for Parks’ golf courses that are nine (9) hole only golf courses; and
WHEREAS, Council acknowledges prior committee reports wherein Parks communicated to Council that several PGA professionals report a willingness to manage both an eighteen (18) hole golf course and a nine (9) hole golf course; and
WHEREAS, Council and Parks consider the PGA professional’s ability to manage a nine (9) hole golf course in addition to an eighteen (18) hole golf course will not adversely affect the PGA professional’s ability to manage either course; and
WHEREAS, Metro has an interest in PGA professionals managing all of Metro’s golf courses so that Metro’s community benefits from the specialized knowledge PGA professionals bring to Metro’s golf courses; and
WHEREAS, Council takes notice that deterioration in the maintenance of Metro’s golf courses may occur if a PGA professional does not manage these Metro properties; and
WHEREAS, Council takes notice that deterioration in the maintenance of Metro’s golf courses requires investing additional resources to restore the facilities, while at the same time proper maintenance leads to increased play and increased revenue.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE “COUNCIL”) AS FOLLOWS:
Section I: That the Council does hereby amend Metro’s Code of Ordinances Chapter 42.43(B):
(B) The person or entity may manage two courses with a maximum equaling no more than 27 holes only manage one Metro-owned golf course at a time - unless there is a death or separation of employment and another Pro fills in on an interim basis during the transition period to keep the Metro-owned golf course open while Metro seeks to fill the vacant position.
Section II: This Ordinance shall be effective upon its passage and approval.
