AN ORDINANCE TO ADDRESS UNDERBUDGET COUNCIL-APPROVED AMERICAN RESCUE PLAN (“ARP”) PROJECTS THROUGH REAPPROPRIATIONS OF ARP FUNDING.

WHEREAS, Louisville Metro Government (“Metro”) is in receipt of $388,295,722 in federal funding through State and Local Fiscal Recovery Funds commonly referred to as American Rescue Plan (“ARP”); and
WHEREAS, use of ARP funds requires approval from the Metro Council pursuant to Resolution No. 052, Series 2021; and
WHEREAS, Metro Council has authorized all ARP funding to specific projects through various legislative actions, which are managed by various Louisville Metro Government departments to address continued impact of COVID-19 on the economy, public health, state and local governments, individuals, and businesses; and
WHEREAS, Metro Council anticipates some projects will be underbudget or not able to use their entire allocation and desires to establish a priority to reallocate those funds.
NOW THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: Unused ARP funds will be reallocated to the following projects in the order shown as funds become available: $6,000,000 additional funding to Louisville Free Public Library for previously approved and funded ARP capital projects at Parkland(LAT-0081), Portland(LAT-0080) and Fern Creek(LAT-0088) branches; $2,500,000 to the Harbor House homeless project entitled ”Intergenerational Life Center;” $2,000,000 for the Stark Building Affordable Housing Project; and up to $5,000,000 for solar equipment in Metro-owned buildings to reduce Metro reliance on fossil fuels.
SECTION II: For any project listed in Section I that has not previously been approved for ARP funding by Metro Council, the project shall be reviewed under the process that was established by Office of Management and Budget and the Louisville Accelerator Team(“LAT”) for all proposed ARP to insure compliance with to ARP Treasury federal standards and requirements prior to any appropriation being made.
SECTION III: This Ordinance shall first be subject to the adopted surplus and shortfall guidelines adopted by Metro Council under Ordinance No. 143, Series 2022. No appropriation may be removed if the funds have been obligated through a contract or agreement unless the project or program is complete and the contract or agreement is closed or cancelled.
SECTION IV: This Ordinance shall take effect upon its passage and approval or otherwise becoming law.
