A RESOLUTION AUTHORIZING THE KENTUCKY TRANSPORTATION CABINET (KYTC) TO ACQUIRE RIGHT-OF-WAY NEEDED FOR THE FAIRDALE ROUNDABOUT.

WHEREAS, Louisville Metro Council has recognized the public benefit of the construction of the Fairdale Roundabout by Louisville Metro Ordinance No. 177, Series 2006; and
WHEREAS, Louisville/Jefferson County Metro Government (Metro Government) and KYTC plan to enter into a contract for the construction of the Fairdale Roundabout by KYTC; and
WHEREAS, Metro Government owns and maintains Mitchell Hill Road and Fairdale Road for which additional right of way is needed to construct the Fairdale Roundabout.
NOW THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION I: The Transportation Cabinet and its agents are hereby authorized, in the name of Metro Government, to acquire right of way needed for the Fairdale Roundabout according to the alignment and widths shown on the plans or revisions thereof, and is authorized to institute condemnation proceedings for such right of way if necessary.
SECTION II: In exchange for KYTC's commitment to reconstruct segments of Fairdale Road and Mitchell Road, Metro Government agrees to accept the assignment and conveyance of ownership interest and maintain or cause to be maintained the following facilities:
Fairdale Road - From station 114+35 to the proposed Fairdale Roundabout
Mitchell Hill Road - From station 130+46 to the proposed Fairdale Roundabout
With this resolution Metro government will accept, by deed or by KYTC Official Order, the assignment and transfer of ownership interest and maintenance responsibility of right of way facilities upon completion of the aforementioned Fairdale Roundabout construction project.
