TITLE
AN ORDINANCE AMENDING THE LOUISVILLE METRO CODE OF ORDINANCES ("LMCO") CHAPTER 51 REGARDING LICENSING FEES.

WHEREAS, licensing fees for waste haulers, found in LMCO 51.300, were updated by Metro Council in 2025; and
WHEREAS, the same fees for waste haulers are also addressed within LMCO Chapter 51.200 which generally addresses the fees for waste management facilities. This section was not amended in 2025; and
WHEREAS, so as to make the licensing fees for waste haulers consistent throughout LMCO Chapter 51 and to place licensing fees for waste haulers into the appropriate section, an ordinance amendment is necessary.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: Section 51.201 of the LMCO is hereby amended as follows:
? 51.201 FEE SCHEDULE.
(A) Pursuant to the authority granted by KRS 68.178(1) and in conformity with the home rule power granted to Metro Government, there is hereby imposed an annual license fee for the operation of a recycling facility, solid waste management facility, landfill or waste disposal facility, or other waste management business.
(B) The fees for these specific licenses are as follows:
Type of Facility License Fee
Landfill 5% per annum of the facility's gross receipts
Waste disposal facilities, other than a landfill or recycling facility 2% per annum of the facility's gross receipts
Solid waste management facilities 2% per annum of the facility's gross receipts
Recycling and composting facilities $100 application fee and $100 annual renewal fee
Waste haulers $100 a year plus $10 per truck
(C) No license fees may be collected from the Metro Government solid waste collection trucks hauling solid waste to a landfill or transfer station and the license fees provided for in this section shall not be co...
