TITLE
AN ORDINANCE AMENDING ? 99.02(B) OF THE LOUISVILLE METRO CODE OF ORDINANCES (LMCO) TO IMPROVE UPON THE REGULATIONS OF THE NOISE ORDINANCE (AS AMENDED).

WHEREAS, Louisville/Jefferson County Metro Government recognizes that noise pollution negatively impacts the public health, safety, and welfare of the citizens of Jefferson County;
WHEREAS, advances in technology make it both easier for private individuals and entities to obtain generators that are less of a public health risk and easier for law enforcement to accurately gauge decibel levels to determine safe levels for the public.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT ("THE COUNCIL") AS FOLLOWS:
SECTION I: The Council hereby amends LMCO ? 99.02(B) by creating a new subsection (7) to read as follows:
(7) The use or operation of any portable generator which exceeds decibel levels of 70dBA by any vehicle.
SECTION II: The Council hereby amends LMCO ? 99.03(B) by amending subsection (11) and removing subsection (13) as follows:
(11) Noises from activities at festivals, entertainment events, parades, and public assemblies, provided a valid permit has been obtained from the Metro Government;
(13) Noises from activities conducted on rights-of-way of the Metro Government, including, but not limited to, festivals and entertainment events, provided all necessary permits have been obtained; and
SECTION III: This Ordinance shall take effect 180 days after its passage and approval.
