AN EMERGENCY RESOLUTION INITIATING A REVIEW OF THE DECISION OF THE PLANNING COMMISSION TO APPROVE A REVISED DISTRICT DEVELOPMENT PLAN FOR THE PROPERTY LOCATED AT 4826 PRESTON HIGHWAY IN LOUISVILLE METRO (AS AMENDED).

WHEREAS, the Development Review Committee of the Planning Commission held public hearings on September 1, September 15, and October 6, 2021 on a proposal to revise the District Development Plan and replace the binding elements for the property at 4826 Preston Highway in Louisville Metro (21-DDP-0048), and the Committee voted to approve the plan by a vote of 5 For, 0 Opposed, 1 Abstention on October 6, 2021; and
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government ("Council") has the power and authority under the provisions of the Land Development Code ("LDC"), Section 11.7.5, to review and uphold, modify, or overturn that decision, and may place additional conditions or binding elements as it deems appropriate; and
WHEREAS, because of the potential impact upon Meadow Avenue, a substandard road, as well as the potential conflicts on heavily trafficked Preston Highway, the Council finds that such a review is warranted; and
WHEREAS, This Ordinance requires emergency consideration as authorized by Council Rule 7.01 because the limitations of the regular Council calendar combined with the requirements of LDC Section 11.7.5 would make it impossible to review this matter without either emergency passage or the scheduling of several special meetings;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT ("COUNCIL") AS FOLLOWS:
