AN ORDINANCE CREATING A NEW SUBSECTION TO LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES ("LMCO") SECTION 72.033 REGARDING THE OBSTRUCTION OF CURBSIDE MAILBOXES (AS AMENDED).

WHEREAS, the parking of vehicles in front of curbside mailboxes has caused residents of Louisville Metro Government to experience difficulties in having their mail delivered; and
WHEREAS, other cities in Kentucky, such as Versailles and Franklin have enacted ordinances regulating the obstruction of curbside mailboxes; and
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") wishes to enact a provision regulating the obstruction of curbside mailboxes during times when mail delivery times.
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: Creates a new subsection of LMCO Section 72.033 as follows:
? 72.033 OBSTRUCTIONAL PARKING; DOUBLE PARKING.
(A) (1) It shall be a parking violation for any person to leave any commercial or industrial vehicle, bus, or any other vehicle or trailer in or on any public way within Metro Government either during the day or night, except while the vehicle is being loaded or unloaded and such loading or unloading operation is actually taking place or while the cab of the vehicle is occupied by the driver thereof.
(2) For purposes of 72.033(A)(1), bus means any motor vehicle designed primarily for the transportation of passengers and having a seating capacity in excess of nine passengers including the driver.
(B) It shall be a parking violation for any person to stop or park any vehicle on the roadway side of any other vehicle stopped or parked at the edge or curb of a street.
