TITLE
A RESOLUTION REQUESTING THE PLANNING COMMISSION REVIEW THE LAND DEVELOPMENT CODE REGULATIONS WITH REGARD TO PRIVATE ROADS.

WHEREAS, Chapter 7 of the Land Development Code (the "LDC") regulates the subdivision of land; and
WHEREAS, Sections 6.2.5.E, 7.3.10.A and 7.8.60.C of the LDC provide that subdivisions shall make connections to adjoining public and private roads which stub into the property; and
WHEREAS, The Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") is concerned about burdening private roads and their owners with the maintenance responsibilities that accompany access to such roads by the broader public; and
WHEREAS, The LDC is inconsistent in its identification of roads, utilizing terms such as "public roads", "public roadways", "public streets", "private roads", "private roadways", and "private streets", none of which are defined terms in Section 1.2.2; and
WHEREAS, The Council believes that such inconsistency of language not only makes the LDC more difficult to search but also risks causing confusion;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: The Planning Commission should undertake a review of the current Land Development Code and adopt amendments thereto regarding the requirement of subdivisions to connect to private roads.
SECTION II: The Planning Commission shall undertake a review of the current Land Development Code and adopt amendments thereto to provide consistent, clarified language regarding public and private roads/roadways/streets.
SECTION III: This Resolution shall take effect upon its passage and approval.
