TITLE
A RESOLUTION REQUESTING THE PLANNING COMMISSION REVIEW THE LAND DEVELOPMENT CODE REGULATIONS WITH REGARD TO THE AMENITIES AN APARTMENT COMPLEX IS REQUIRED TO CONSTRUCT FOR ITS RESIDENT CHILDREN.

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") has taken notice of a deficiency of amenities for children who live in apartment complexes; and
WHEREAS, children who live in apartment complexes deserves the same access to safe, enjoyable, outdoor physical activity as those who grow up in other types of housing; and
WHEREAS, the drive aisles and parking lots of apartment complexes are less well suited to childhood play than the driveways of detached housing; and
WHEREAS, many apartment developments have ample land on which ball fields, jungle gyms, and other outdoor amenities could be constructed; and
WHEREAS, it may be appropriate to provide an allowance for more vertical apartment development in order to make room for amenities for children; and
WHEREAS, any requirement for an apartment complex to incorporate amenities for children should be proportional to the number of units in the development; and
WHEREAS, there are multiple potential options to address this apparent shortage.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: The Planning Commission shall undertake a review of the current Land Development Code and adopt amendments thereto to update it with regards to amenities for children in apartment developments.
SECTION II: This Resolution shall take effect upon its passage and approval.
