Title
AN ORDINANCE AMENDING SEVERAL SECTIONS OF THE LOUISVILLLE/JEFFERSON COUNTY METRO GOVERNMENT CODE OF ORDINANCES ("LMCO") SECTIONS 72.200 TO 72.999 (THE RESIDENTIAL PARKING PERMIT PROGRAM ORDINANCE).

WHEREAS, the current Residential Parking Permit Program Ordinance was approved in 2005; and
WHEREAS, Section 72.213 of that Ordinance contemplates periodic reporting and review of the program in order to allow the Legislative Council of the Louisville/Jefferson County Metro Government (the "Council") to evaluate the program for "its effectiveness and desirability" and further provided that Council "may pass an ordinance to adjust or amend the RPPP;" and
WHEREAS, Section 72.213 of that Ordinance also provides that "only two RPPP's may be implemented within the Louisville Metro without further approval by the Metro Council;" and
WHEREAS, the Louisville Metro Planning Commission on August 20, 2020 passed Resolution No. 20-LDC-0001 recommending approval of text amendments to Chapter 9 of the Land Development Code ("LDC") to the Council and other jurisdictions with zoning authority;
WHEREAS, the text amendments to Chapter 9 to the LDC would reduce minimum parking requirements in certain areas as suggested in Plan 2040 Comprehensive Plan, which may create a demand for additional RPPPs beyond the two currently authorized by the Ordinance; and
WHEREAS, based on the review and the evaluation of the RPPP over time, and the proposed reduction in minimum parking requirements, it is appropriate to remove the limit on the number of RPPP's that may be approved and to make other amendments necessary to continue the effectiveness and desirability of the RPPP.
NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
