WHEREAS, disclosure of information regarding the financial impact of resolutions and ordinances on the Metro Government Budget is in the public interest; and,
WHEREAS, a request for preparation or review of a Financial Impact Statement is most appropriate at the Committee level,
NOW THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION I: LMCO Section 30.45 is amended to read as follows:
? 30.45 FINANCIAL IMPACT STATEMENTS.
(A) Statements. Except as provided in subsection (B), any ordinance or resolution, which requires the acceptance or expenditure of unbudgeted monies by the Metro Government, shall be accompanied by a financial impact statement, as provided in Exhibit A attached to Ordinance No. 11-2004, approved 2-9-2004, before the ordinance or resolution may be introduced before the Metro Council. Any amendment to an ordinance or resolution that modifies the financial impact statement shall require a corollary modification to such statement.
(B) Exception for annual operating and capital budget ordinances and acceptance of donations or grants. This section shall not apply to the Metro Government's annual operating and capital budget ordinances nor any resolution or ordinance, which provides for a donation or grant to the Metro Government, nor to any ordinance or resolution approving a collective bargaining agreement, unless the majority of the presiding committee votes to request a financial impact statement.
