A RESOLUTION AUTHORIZING THE TRANSFER OF THREE (3) PARCELS OF REAL PROPERTY LOCATED ON BROADLEAF DRIVE, OWNED BY LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT ("METRO GOVERNMENT"), TO HABITAT FOR HUMANITY OF METRO LOUISVILLE.

WHEREAS, according to KRS 67C.101, Metro Government may sell any real property belonging to Metro Government; and
WHEREAS, the real property which is the subject of this Resolution has been acquired with grant funds from the Commonwealth of Kentucky's Neighborhood Stabilization Program ("Grant") for the public purpose of redeveloping said property into single family homes for sale to low, moderate and middle income households; and
WHEREAS, Metro Government desires to convey the subject property to Habitat For Humanity of Metro Louisville for redevelopment and ultimate sale to eligible homebuyers in accordance with the terms of the Grant; and
WHEREAS, Section 1 (A) of Executive Order No. 2, Series 2011, which adopts Section 2 (C) of Metro Mayor's Executive Order No. 3, Series 2007, provides that Metro Government may sell and convey surplus real estate upon a declaration by the Legislative Council of Metro Government ("the Council") that such property is no longer needed for any other governmental purposes of Metro Government; and
WHEREAS, per the terms of the Grant, Metro will retain a mortgage in the amount of the fair market value on each of the three subject properties to secure the redevelopment of each property by Habitat For Humanity of Metro Louisville; and
WHEREAS, except for the public purpose set out in the Grant, the Director of Develop Louisville has declared and certified to the Council (See Exhibit A attached hereto and made a part hereof) that the real property, which is the subject of this Resolution, is otherwise surplus to the needs of Metro Government.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION I: The Council finds that the real property described below was acquired with grant funds from the Commonwealth of Kentucky Neighborhood Stabilization Program and shall be conveyed to Habitat For Humanity of Metro Louisville for the public purpose of redevelopment into three new single family homes, for low, moderate and middle income households. Furthermore, Council determines that except for the public purpose set out in the Grant, the subject property is surplus or otherwise no longer needed to carry out any other governmental function of Metro Government.

SECTION II: The Metro Mayor is hereby authorized to convey the properties named herein, subject to a mortgage on each of the properties in the amount of the fair market value for each such property and in accordance with the terms of the Grant, to Habitat for Humanity of Metro Louisville without further action by the Council.
SECTION III: This Resolution shall become effective upon its passage and approval.
