AN ORDINANCE AMENDING SECTION 115 OF THE LOUISVILLE METRO CODE OF ORDINANCES (LMCO) RELATING TO SHORT TERM RENTALS. (AS AMENDED).

WHEREAS, Ordinance No. 217, Series 2015 amended LMCO Section 115 relating to Short Term Rentals; and
WHEREAS, LMCO Section 115 requires an annual registration for short term rentals; and
WHEREAS, Metro residents have for many years rented their premises during the Kentucky Derby period without intending to create a short term rental at any other time; and
WHEREAS, a short term rental during this period is a benefit to both residents and visitors to this internationally renowned event; and
WHEREAS, Metro Council desires to enable this longstanding practice without the added burden of an annual registration.
NOW, THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (THE COUNCIL) AS FOLLOWS:
SECTION 1. LMCO Section 115.515, et. seq., of the Louisville Metro Code of Ordinances is hereby amended with the addition of a new subsection 115.522 as follows:
Section 115.522 EXEMPTION
No registration shall be required for any short term rental in which the only short term rental contract on an annual basis is confined to 10 consecutive days or less during the period beginning 8 days prior to the Kentucky Derby and ending the day following the Kentucky Derby.
Section III of Ordinance No. 217, Series 2015 is hereby amended to change the effective date to August 1, 2016.
SECTION 2. This Ordinance shall take effect upon passage and approval.
