AN ORDINANCE EXTENDING THE TEMPORARY MORATORIUM ON THE ISSUANCE OF PERMITS FOR ANAEROBIC DIGESTION FACILITIES FOR BIODEGRADABLE MATERIALS ESTABLISHED IN ORDINANCE NO. 037-16.

WHEREAS, Louisville Metro Government originally anticipated that a review of the zoning regulations related to anaerobic digestion facilities in the Land Development Code as well as existing land use regulations from other jurisdictions that address anaerobic digestion facilities could be completed in six months;
WHEREAS, Louisville Metro Planning & Design needs additional time to compile its findings and finalize its report;
WHEREAS, the Louisville Metro Council desires to preserve the status quo until Metro council may fully consider and adopt zoning regulations related to anaerobic digestion facilities for biodegradable materials; and
WHEREAS, Louisville Metro Planning & Design believes an additional twenty (20) days is sufficient to comply with Louisville Metro Council’s charge as established in Ordinance No. 037-16.
Now therefore be it ordained by the Legislative Council of the Louisville/Jefferson County Metro Government as follows:
Section I: The Metro Council hereby provide a twenty day (20) extension to the temporary moratorium established in Ordinance number 037-16 to allow the Louisville Metro Planning & Design to compile its findings, finalize its report, present the report to the Planning Commission during a public hearing, and for the Planning Commission to submit its recommendations to Louisville Metro Council for consideration.
