WHEREAS, Twenty-eight (28) homes located on Ormond and Flint Roads in Louisville Metro and adjacent to the City of St. Matthews, as described in the attached documentation, unanimously requested and consented to become a part of the City of St. Matthews;
WHEREAS, on January 24, 2017, the City of St. Matthews Council approved Ordinance No. 17-01 declaring its intent to annex the 28 homes on Ormond and Flint Roads adjacent to the City of St. Matthews;
WHEREAS, the City of St. Matthews Council stated in its Ordinance No. 17-01 that "the City of St. Matthews can provide the area needed city services including, garbage collection, road maintenance, snow removal and street lighting" to the 28 homes to be annexed;
WHEREAS, KRS 67C.111(3) requires the City of St. Matthews obtain approval of the annexation from Metro Council prior to the City of St. Matthews proceeding with the annexation requirements under KRS Chapter 81A;
WHEREAS, KRS 67C.111(3) gives Metro Council the authority to approve or deny annexation requests "by ordinance and within sixty (60) days of the receipt of the request" and if Metro Council does not act within "sixty (60) days, the request for a city to proceed with an annexation proposal shall be deemed to be approved;"
WHEREAS, the City of St. Matthews filed an annexation request on January 31, 2017 with the Office of the Metro Council Clerk asking the Legislative Council of the Louisville/Jefferson County Metro Government ("Metro Council") approve the annexation of the 28 homes as described in the attached documentation;
