A RESOLUTION REQUESTING THAT THE PLANNING COMMISSION INITIATE THE PROCESS OF IMPLEMENTING LAND USE RECOMMENDATIONS CONTAINED IN THE EXECUTIVE SUMMARY OF THE IRISH HILL NEIGHBORHOOD PLAN UPDATE PERTAINING TO THE CHANGE IN ZONING OF PROPERTIES IDENTIFIED THEREIN, HOLD A PUBLIC HEARING AND FORWARD ITS RECOMMENDATIONS TO THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT FOR FINAL ACTION.

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (the “Council"), under Ordinance No. 155, Series 2017, adopted the Irish Hill Neighborhood Plan Update and appended its Executive Summary to Cornerstone 2020, the Comprehensive Plan, pursuant to Chapter 161 of the Louisville/Jefferson County Metro Code of Ordinances (“LMCO”), entitled "Neighborhood Plans;"
WHEREAS, LMCO Chapter 161 contains provisions guiding the amendment and review of adopted neighborhood plans, and the Council wishes to implement that process in response to certain recommendations stated in the Irish Hill Neighborhood Plan Update;
WHEREAS, the Executive Summary of the Irish Hill Neighborhood Plan Update sets forth various recommendations for specific changes in zoning for a number of properties located in the Irish Hill Neighborhood as depicted on the map attached hereto as Exhibit A;
WHEREAS, the Metro Council wishes to implement said land use recommendations of the Executive Summary of the Irish Hill Neighborhood Plan Update, specifically to (1) change the zoning of the 54 parcels of property identified on Exhibit B hereto to a mixed use Planned Development District as further described in the Plan; (2) rezone the properties located at 361 - 381 Baxter Avenue (Tax Block 068D, Lots 1, 3, 50, 52, 53, 54, 55, and 56) from EZ-1 Enterprise Zone to C-2 Commercial; and (3) rezone the property located at 1234 Lexington Road from OR-2 Office Residential to R-7 Multi-Family Residential; and
WHEREAS, in accordance with the Irish Hill Neighborhood Plan Update, the Metro Council finds that the specific zoning changes for the Irish Hill Neighborhood suggested herein are proposed in order to address land uses that are conflicting or have the potential to create land uses that are incompatible in terms of intensity, external impacts, building scale and types, and to encourage future development that aligns with the vision of the Irish Hill Neighborhood Plan Update.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“METRO COUNCIL”) AS FOLLOWS:
SECTION I: The Metro Council requests that the Planning Commission initiate the process of implementing the land use recommendations as set forth hereinabove and as in the Executive Summary of the Irish Hill Neighborhood Plan Update and, following a public hearing on the subject, forward its recommendations as required to the Metro Council for further action.
SECTION II: This Resolution shall take effect upon passage and approval.
