ORDINANCE NO. _________, SERIES 2017
AN ORDINANCE AMENDING LOUISVILLE METRO CODE OF ORDINANCES (“LMCO”) SECTION 164.30 ET SEQ., THE SYSTEM DEVELOPMENT CHARGE, TO REQUIRE INCREASED CONTRIBUTIONS AND ELIMINATE THE SUNSET PROVISION.
WHEREAS, the System Development Charge (“SDC”) was adopted by the Metro Council in 2006 (Ordinance No. 66, Series 2006) and will expire pursuant to LMCO § 164.50;
WHEREAS, the SDC should be extended; and
WHEREAS, the SDC should be amended to increase the required contributions to better ensure that adequate roadway infrastructure is provided in developing areas of Metro Louisville;
WHEREAS, the increased fees are needed to pay for new road infrastructure for new development. The current fees are dedicated to pay off bonds for past infrastructure needs. The additional fees will be used exclusively to pay for new projects and none of them will be applied to existing bonded indebtedness and will be spent within the district where the fees are collected.
NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:
SECTION I: LMCO §§ 164.30(A)(2)(a), (b) and (c) are amended as follows:
(a) For single-family detached units, detached condominium units, and mobile homes, the system development charge shall be $1,0002,500 per unit.
(b) For attached condominium units, the system development charge shall be $5001,250 per unit.
(c) For multi-family apartment (for rent) units, the system development charge shall be $250625 per unit.
SECTION II: Pursuant to LMCO § 164.50, the SDC is reenacted for an additional period of ten (10) years from the effective date of this Ordinance.
SECTION III: This Ordinance shall take effect upon passage and approval.
