TITLE
AN ADMINISTRATIVE RESOLUTION TO MANAGE THE STAFF OF DISTRICT 21 FOLLOWING THE VACANCY OF THIS SEAT.

WHEREAS, Dan Johnson entered into a Stipulation and Agreed Order regarding his Removal from office on November 1, 2017;
WHEREAS, it was determined that Dan Johnson violated the terms of the November 1, 2017, agreement, resulting in the termination of the stay of his removal;
WHEREAS, District 21 is now vacant and there is no one to deal with emergency staffing issues;
WHEREAS, Just prior to his November 1, 2017, agreement Dan Johnson hired a staffer at the sum of $63,000 per annum;
WHEREAS, this has resulted in District 21 operating at a deficiency and there are not enough funds to pay the three staffers presently employed to operate District 21;
WHEREAS, District 21 has neither the resources nor the need for three staffers and there is no one to supervise the same; and
WHEREAS, this is a Council Administrative Function which pertains to an administrative act or function of the Council which may be voted upon at the same meeting at which it was introduced.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I: The Council hereby resolves to layoff the "at will" employee hired on or about October 4, 2017 as there are insufficient funds to pay this individual from District 21 funds.
SECTION II: The two remaining part-time employees in District 21-consisting of a Staff Helper and an Administrative Clerk-will continue to be paid those hourly rates according to Section 10 of the Louisville Metro Council Policies and Procedures and shall continue on an at will basis until further action of this Metro Council or the newly appointed representative of District 21.
