A RESOLUTION SUPPORTING AN AMENDMENT TO KRS 311.727 BY THE KENTUCKY GENERAL ASSEMBLY REGARDING INFORMED CONSENT PRIOR TO HAVING AN ABORTION PERFORMED

WHEREAS, abortion on demand was legalized by the United States Supreme Court on January 22, 1973; and

WHEREAS, over 59 million innocent unborn American children have died by legalized abortion since that date; and

                     WHEREAS, ultrasound requirements serve an essential medical purpose in confirming the presence, location, and gestational age of a pregnancy as well as diagnosing ectopic pregnancies which, if left undiagnosed, can result in infertility or even fatal blood loss; and

                     WHEREAS, it is critical to the psychological and physical well-being of a woman considering an abortion that she receive complete and accurate information on the reality and status of her pregnancy and of her unborn child; and

                     WHEREAS, a woman considering an abortion does not currently receive complete and accurate information on the reality and status of her pregnancy and of her unborn child because she is not always given the opportunity to view an ultrasound image of her unborn child or to hear her unborn child's heartbeat; and

                     WHEREAS, the decision to abort is an important, and often a stressful one, and it is desirable and imperative that it be made with full knowledge of its nature and consequences; and

                     WHEREAS, the knowledgeable exercise of a woman’s decision to have an abortion depends on the extent to which the woman receives sufficient information to make an informed choice between the two alternatives of giving birth or having an abortion; and

                     WHEREAS, the purpose of House Bill 103 is to protect the physical health and welfare of every woman considering an abortion; and

                     WHEREAS, the purpose of House Bill 103 is to reduce the risk that a woman may elect an abortion, only to discover later, with devastating psychological consequences, that her decision was not fully informed.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“THE COUNCIL”) AS FOLLOWS:

 

SECTION I:                     The Louisville Metro Council, by this Resolution, supports House Bill 103 and the Kentucky General Assembly’s desire to protect the physical health and welfare of every woman considering an abortion and to protect the unborn child from a woman’s uninformed decision to have an abortion.

SECTION II: Louisville Metro Council recognizes that the decision to have an abortion is often a stressful one and depends on the extent to which the woman receives sufficient information to make an informed choice between the two alternatives of giving birth or having an abortion.

SECTION III:  This Resolution shall take effect upon passage and approval.
