A RESOLUTION REQUESTING THE LOUISVILLE METRO PLANNING COMMISSION, THROUGH ITS STAFF WITH PLANNING & DESIGN SERVICES, TO INITIATE THE ZONING AND FORM DISTRICT MAP AMENDMENT PROCESS AS RECOMMENDED BY THE SOUTHEAST METRO REGIONAL CENTER PLANNING STUDY.

WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government ("Metro Council") adopted the Southeast Metro Regional Center Planning Study and appended its Executive Summary to Cornerstone 2020 - the Comprehensive Plan - on August 14, 2012, pursuant to the Louisville/Jefferson County Metro Code of Ordinances (“LMCO”) Chapter 161, entitled "Neighborhood Plans;"

WHEREAS, the Metro Council understands that LMCO Chapter 161, "Neighborhood Plans," contains provisions guiding the amendment and review of adopted neighborhood plans, and wishes to implement that process in response to certain recommendations stated in the Southeast Metro Regional Center Planning Study;

WHEREAS, the Metro Council understands that the Executive Summary of the Southeast Metro Regional Center Planning Study sets forth various recommendations that, together, suggest an area-wide rezoning for a number of properties located within a specified area of Fern Creek as depicted on a map, attached hereto as Exhibit A, in addressing issues of traffic congestion, development impacts, and community character, and in anticipation of future growth, a proactive response is needed to guide this area toward becoming a vibrant activity center for residents, employees, and visitors. It was recognized that a Regional Center Form District designation for a part of the study area would do much to achieve the desired future development character;

WHEREAS, the Metro Council, through the Planning Commission and its supporting staff, wishes to address said land use recommendations of the Executive Summary of the Southeast Metro Regional Center Planning Study, including the following particular recommendations: 1) Designate as a Regional Center Form District (RCFD) the specified area indicated on the Recommended Regional Center Form District Boundary (Recommendation CF-1; Exhibit 1, Appendix A); and 2) Consider a Planned Development District (PDD) in conjunction with the Regional Center Form District to promote mixed use and consistent design of development and to implement the recommendations of this study. Any consideration of a PDD will involve working closely with affected property owners (Recommendation CF-8), where appropriate; and

WHEREAS, the Metro Council wishes to initiate the process of implementing the land use recommendations contained in the Southeast Metro Regional Center Planning Study’s Executive Summary, especially those recommendations as more specifically set forth herein.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT (“METRO COUNCIL”) AS FOLLOWS:

 

SECTION I: The Metro Council requests that the Planning Commission initiate the process of implementing the land use recommendations contained in the Southeast Metro Regional Center Planning Study (Recommendations CF-1 and CF-8), and, following a public hearing on the subject, forward its recommendations as required to the Metro Council for further action.

SECTION II: This Resolution shall take effect upon passage and approval.
