TITLE
A RESOLUTION REQUESTING THE ATTORNEY GENERAL TO APPOINT A SPECIAL PROSECUTOR TO INVESTIGATE FORMER LOUISVILLE POLICE DEPARTMENT OFFICER MARK HANDY.

WHEREAS, Kentucky Revised Statute ? 15.200 allows the Attorney General, when requested by the "majority of a city legislative body," to "intervene, participate in, or direct any investigation or criminal action, or portions thereof, within the Commonwealth of Kentucky necessary to enforce the laws of the Commonwealth[;]"
WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government ("Metro Council") is concerned that former Louisville Police Department Officer Mark Handy may have engaged in criminal conduct, which may have contributed to the wrongful conviction of Edwin Chandler following the murder of Brenda Whitfield;
WHEREAS, Edwin Chandler spent nine years in prison and another seven years on parole before he was exonerated in 2009;
WHEREAS, evidence in the file suggests that former Officer Handy falsified portions of his investigation and coerced a confession from Edwin Chandler; and
WHEREAS, former Officer Handy has been involved in other cases in various counties in the Commonwealth of Kentucky in which similar allegations have arisen.
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT ("METRO COUNCIL") AS FOLLOWS:
SECTION I: The Metro Council requests that the Attorney General appoint a special prosecutor to screen the file and, if necessary, to prosecute former Louisville Police Department Officer Mark Handy for any criminal activity in connection with his investigation of Edwin Chandler after the murder of Brenda Whitfield.
