AN ORDINANCE AMENDING SECTIONS 42.40, 42.41, AND 42.42 OF THE LOUISVILLE METRO CODE OF ORDINANCES (“LMCO”) REGARDING THE REVISION OF GREENS FEES AND GOLF CART AND TRAIL FEES AND CREATING A NEW SECTION OF CHAPTER 42 TO ADDRESS THE MANAGEMENT OF METRO-OWNED GOLF COURSES. (AS AMENDED).

                     WHEREAS, the Legislative Council of the Louisville/Jefferson County Metro Government (“Metro Council”) finds that the Metro-owned golf courses are important assets that provide a quality golfing experience for the citizens of Louisville Metro;

                     WHEREAS, these Metro-owned golf courses contribute to the health and wellness of the citizens of Louisville Metro;

                     WHEREAS, the cost of maintaining these Metro-owned golf courses is expensive and exceeds the revenue produced by the greens fees; and

WHEREAS, increasing the greens fees would help offset the costs of maintaining the courses and extend the longevity of these important assets;

NOW, THEREFORE, BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

 

SECTION I:                     LMCO Section 42.40 is amended as follows:

42.40  DEFINITIONS.

For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

   ACTIVE DUTY MILITARY.  Persons supplying proper identification that they are full-time, active military personnel of the United States.  Such term includes full-time training duty, annual training duty, and attendance, while in the active military service, at a school designated as a service school by law or by the Secretary of the military department concerned.

   ANNUAL PASS - 7-DAY. Green-fee pass for adults, good any day of the week during the calendar year in which it is issued.

   ANNUAL PASS - WEEKDAY.   Green-fee pass good only Monday through Friday during the calendar year in which it is issued.  Issued in three categories: Adult, Junior, or Youth Team.

   JUNIOR.   Persons age 18 and younger.

   MATINEE.   Weekdays from 4:00 p.m. to 6:00 p.m., during the summer season only.

   SENIOR.   Persons age 6260 and older.

   SUMMER SEASON.   March 1 through November 30.

   TWILIGHT.   Begins 6:00 p.m. on weekdays during the summer season; begins at 4:00 p.m. on weekends during the summer season; and begins at 2:00 p.m. every day during the winter season.

   WINTER SEASON.   December 1 through February 28.

SECTION II:                     LMCO Section 42.41 is amended as follows:   

42.41  GREEN FEES.

 

   (A)   All golfers must pay the established green fee, start in the order designated by the duly-appointed starter at the clubhouse, and have the green fee receipt in his or her possession at all times while playing on the course.  The golf pro or his or her designee shall have the authority to restrict usage of all golf practice facilities to those having paid for a green fee for that day, if overcrowding occurs.

 

   (B)   Green fees shall be established at the rates set forth herein, effective March 1, 2006 March 1, 2018.  Thereafter, upon review every two years, the fees may be increased by the greater of: (i) $0.25 or (ii) an amount based on the most recently published Consumer Price Index (CPI), provided such CPI-based amount is in increments of $0.25The increase shall be instituted only when the amount equals or exceeds $.25, and shall be made in increments of $.25.  If costs require rate increases above this level, the Director of Parks may request a higher increase upon approval by the Metro Council.

   (C)   Fee schedule.

 

      (1)   Annual passes shall be issued on a calendar year basis, and are not prorated. Additionally, an annual pass fee shall be assessed each time the pass is used, as set forth herein.

         (a)   7-day pass:  $375

 

         (b)   Weekday pass:

 

              Adult:               $270

               Junior:               $90
              Youth Team: (team season only)   $60

 

      (2)   Daily fees.

 

         (a)   Seneca and Charlie Vettiner Courses.

SECTION III:                       LMCO Section 42.42 is amended as follows:  

42.42  GOLF CART AND TRAIL FEES.

 

   (A)   Effective March 1, 2006March 1, 2018, persons operating user-owned carts shall pay a $4.004.50 trail fee for each round of golf.

   (B)   Golf cart discount cards are available at a charge of $75 per year, and each cardholder will be assessed a $9.0011.00 fee per round.  

   (C)   Persons wishing to have trail-cart privileges must have a valid registration card issued by the Department of Parks.

                     SECTION IV:  A new section of LMCO Chapter 42 is hereby enacted to read as follows:

42.43  MANAGEMENT OF METRO-OWNED GOLF COURSES.

 

                                          If Metro Parks contracts with a private entity or person for the management of any Metro-owned golf courses, the following restrictions must be contained in any future request for proposal and subsequent contract executed for the management of the property:

                       (A)    The person or entity must be or employ a PGA certified golf professional Class A PGA Member (“Pro”) to manage each Metro-owned public golf course;

                     (B)                     The person or entity may only manage one Metro-owned golf course at a time-unless there is a death or separation of employment and another Pro fills in on an interim basis during the transition period to keep the Metro-owned golf course open while Metro seeks to fill the vacant position ;

                     (C)                     The person or entity may not manage another competing course, whether private or semi-private, while maintaining a contract to manage a Metro-owned public golf course;

                     (D)                     The person or entity shall employ staff to manage the clubhouse, concession stand, and golf carts as well as hold all applicable licenses and certifications (Liquor license, insurance, Health Department, Revenue Commission, etc.);

                                          SECTION IVVThis Ordinance shall take effect upon its passage and approval. However, Section IV of this Ordinance does not apply nor shall be read to affect existing contracts regarding the management of Metro-owned golf courses.
